    Hi,

Need some advice about this please.

I received a PCN from a company call SMART Parking ltd. It was for entering an outside car parking area apparently on private land, for just 13 minuets, and then leaving. The problem was for some reason I couldnt connect to their payment app with my phone. I tried  but just could connect, so then I left. I never got out of the car. Four weeks later I received a PCN. I wrote straight back to them and explained the circumstances about my connection problem, and that I never got out of my car. But they wrote back to me and said that having considered my appeal they have decided to uphold the PCN, and asking for £100
They are advising me that if I want to appeal I can go through the POPLA appeal process. But from what I'm reading this process is biased towards the car parking company. Shall I ignor this and go to court ?
We really wish you'd come here for advice BEFORE throwing away your 100% guaranteed win by appealing the way you did...

Next time, don't appeal in your own words as driver.  Threw away the easy win.  Smart are impossible to lose against, had you done it right and appealed without saying who was driving.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Hi again. Bit of an update. Debt Recovery plus has passed this onto CST law and the Keeper has until 8 March to settle or it will apparently go to court. Does this change anything?
  • For clarity, this is what todays post relates to....

    Hi there.

Sorry to raise this topic again, but would appreciate advice….

The keeper of a vehicle has received a PCN for ‘driver – observed leaving site’. The image on the initial PCN simply shows someone getting out of a car, it does not evidence that person leaving site. Plus, a time is stated but there is no period of parking provided.

Initially the PCN was ignored but then contested (late) and now debt recovery letters are arriving, with costs of course going up….

Should the keeper continue to contest due to the initial notice failing to provide the information required by POFA or cut their losses and settle?

    Hi OP

I've read dozens of threads on these forums where posters are told not to pay and I have asked what would happen once the debt collectors start knocking on the door but no one has responded.

Hopefully, you will now get advice how to get rid of debt collectors/letters/etc.

TBH, when I see some posts telling posters to do this and that, in the back of my mind is the scenarios your are now encountering, so please keep us updated once you get more help from the regulars in this section

    Good luck

    Have you really?

Perhaps you should read a few more threads on this board.

Debt collectors can not turn up at the OP's door.

Please show 'us' an example of when that has happened!

    Thanks.

Probably because you are imagining something that doesn't happen.  I think your posts might come across as scaremongering, which is unfair on newbies.

No debt collectors knock on the door, before the small matter of going to court, the PPC actually winning (rare) AND the person then refusing to pay the small sum ordered by a court...

    It won't happen.

And you forgot to tell the OP that CST are the same as Debt Recovery Plus (same group) and of course this trash is to be ignored.
