Boiler warranty voided by previous owner?

Hi, I’ve just been told by warranty provider (after my boiler started leaking) that the previous owner of my house skipped a service voided the boiler warranty, and they won’t allow me to claim it as a new home owner despite servicing it every year I have had it. 

Is this really the case?

    Makes sense - it's a fairly common condition of warranties that you service it regularly. Have you read the warranty yourself to check that's what it says?

    how many times have you had it serviced? sounds like at least 2-3 years.
    I can't think of any practical reason that a service missed 5 years ago (for example) has any bearing on a leak that's happened now (after multiple intervening services). It would be much more likely that a general age / wear & tear clause would be found.
    Did you answer the questions fully when you signed up?
    Was the warranty specifically for the boiler or more general home maintenance warranty?
    I'd be inclined to complain / ask for a second opinion on the basis of reasonableness.
    P.s. I've just had a boiler repair carried under warranty after having missed my last service (my bad practice i know... but just letting you know that not every warranty provider looks for every escape clause possible)

    Please put it down to a lesson learned.

    To me, most warranties when buying an older house are not worth the paper they are written on unless back up by an insurance warranty.

    Re boilers, we bought a rental about 5 years ago and we asked re a warranty and the seller there was one and about 6 months left on it. I asked to look at the service log but he could not find it and said he'd contact the EA when he did. He never did and three days went by and we asked for a date of installation/receipt - did not get one. However, we still purchased it on the basis the guy was lying but we were happy with the price.

    Unless you can see the property paperwork and the signatures/address/phone, I'd take it with a pinch of salt.

    To make it easier for you and no disrespect. The boiler people are correct so please move on. Seek and independent warranty for the future if you wish. In my home, we have a BG warranty never needed to use them and hope we never do but for a piece of mind.
  • Thanks everyone for your contributions, fortunately I had already took out home emergency cover and they approved the work. 

    There were delays in paperwork being filled out but the guy decided to drop by as he was in the area and put the part in so we didn’t have to chill for another night. 

    It is still dripping hopefully from leftover of old part so waiting and seeing but for now, I’m looking forward to a lunch break shower!
