Parking Ticket in a layby

I drove to the Peak District and parked in a layby on Saturday morning.

It was in a remote area - near Mam Tor, out in the countryside and I arrived at 6.30am. I got a parking ticket around 7.15am as I had parked in a layby but with double yellow lines next to it.

Aren't the yellow lines to stop people parking on the other side of them - not the layby side ?

It was pre-sunrise and there was no lamp post lighting with it being in a remote location, also no parking signs or any kind of parking signs for that matter.

I can't understand how someone can do that for a job - driving around in a remote location in the countryside, on a Saturday morning, issuing parking tickets at 7.15am.

Just wondering if it is worth trying to get the parking ticket cancelled ?

    Layby or passing place?

Double yellow lines mean no parking anywhere on the highway, which includes the carriageway, the verge, any footway etc etc. Unless the "layby" was specifically marked as a parking space, the assumption is that the parking restriction applies to it too.
  • A link to Google Streetview would be helpful.
  • Had a quick look around on Google Maps and the only road around there with double yelow lines appears to be the A623. It has several places where cars can pull in and park but the yellow lines stop each side of the parking area. I did find this one where clearly cars seem to have parked beyond the permitted stopping area and the yellow lines are present.

I know - there's a layby around 50 feet away with no yellow lines! But I could only see them when I got back to my car in daylight!

So not a lay by then, I'm sure it could be argued that you should have been able t see the yellow lines when pulling over, assuming your headlights were on.

Having no signs is irrelevant, yellow lines means no parking at any time, there doesn't have to be a sign to tell you that.

Just realised I've posted this in the the general motoring forum instead of the parking tickets forum where people are more in tune with these things - apologies!

The yellow lines restriction applies to the whole highway on that side of the road - yours is no more valid an argument than the people who think if they park entirely on the pavement they're in the clear!

I think you'll find that if you read my OP I was merely asking the question - not arguing - as is often the case on the Internet people seem predisposed to wading in with an argument against a question and not an actual argument!

You don't need to be particularly 'in tune' - just read the Highway Code - to know that DYLs mean 'no waiting at any time', unless there is a sign to the contrary.

Apologies - in which case the answers to your questions are "no" and "no".

Or to look at it another way, do you think somebody would take the time to travel out there issuing tickets if they weren't sure that they were valid?
