Speed camera flashed when I was on the right speed

Hi

Yesterday I was driving on the m25 towards stansted. I went through a variable speed limit of 50 and then 40. I was using the cruise control and I was at 40 when I passed that sign, but a camera flashed behind me.

im not even sure the camera that flashed was on top of me, but I assume it was

Can a camera flash when you are within the limit? If so, what can I do if it says I was a speed I wasn’t?

Yes a camera can flas as you stated if it is faulty. I've not seen one on the motorway but one about a mile from us flashed as we passed it at 29/30 in a 30 zone, got me a tad worried but on the way back as we drove towards it we noted it flashed two other cars which appeared to be doing around 30. Then we stopped and had a look and it clocked a few more cars. We heard nothing ans this was years ago.
  • Hopefully that’s the same here. If I receive a ticket saying I was at more speed, how can I prove the camera is faulty?

I would suggest you worry about it if and when you actually get a ticket. Are you sure it wasn't just set off by somebody else?

It's extremely unlikely that the camera was faulty, and if it was it would be spotted pretty quickly, given the number of false reports which would result on the UK's  busiest road. Probably another vehicle.

Over the years I've been in the vicinity of speed cameras when they have gone off numerous times, quite a few when being overtaken by blue light vehicles.

At night the flash is very noticeable and the assumption is its for your vehicle.

I've never received the envelope.  Until you do don't worry about it.

Request the photos. There should be two at a fixed time apart, and markings on the road. Based on the markings you can see how far the vehicle travelled in the interval time.

Another option is to drive past it with someone filming the speedo. Then you will have proof you were doing the speed limit (confirmed by MOT certificate for the vehicle) at a time when the camera flashed you.

Incorrect setting is not uncommon. There was one near me that was set up wrong for years. Eventually one of that victims challenged it and the mistake was discovered. Years of false accusations that needed to be undone.

The OP would not be entitled to photos until they plead not guilty. The police may however provide them to assist in identification of the driver.

How does filming post event prove the speed at the time of the alleged offence?

They don't calibrate speedos on an mot.
  • A speed camera once flashed at me. I was being overtaken by a city tax iat the time. I was driving a hire car. Guess which one of us got the speeding notice!
I ignored the notice and waited for a court date, when photographic evidence would have had to be provided. No court summons arrived. I phoned the police to find out what was going on. They told me they had dropped the case.
