Gatwick North Terminal Drop off PCN without Stopping
Hello to all. I have another problem. These Car Parking company is harassing drivers a lot.
I received PCN for Driving through Gatwick North drop off. Did not enter the drop off lanes and drove straight out. As per the PCN entry and exit time, I was there for 1 minute 3 sec and how can someone drop off in 1 minute. I took wrong turn, rather than going to North Terminal Valet car park I went through Drop off area (too many confusing signs around that area). I have proof of Booking in Valet Parking from 11am on 24/09/2022 for 1 week that cost me £120. I realised having driven through the Drop off area and I asked the Valet parking agent if I must pay, and the agent said if I had not dropped off then no need to pay. But now I received this. This is an absolute greed of NCP. They just want to make money out of drivers. I know they are asking for £15 reduced amount payment, but this is not fair that they do such bad practice and trick drivers into paying. Already paid £120 for parking in North Terminal.
My question is do I appeal saying that I just passed through the Drop off area without stopping and attach my booking details for parking at North Terminal Valet Car Park. Or do I appeal under NTK non-POFA – Date of incident 24/09/2022 and Date of sending notice 07/11/2022 which exceeds the POFA 14 day period by 30 days. (found the below letter in the forum that I am thinking to use).
Also they have given 14 days (by 21/11/2022) to pay discounted amount of £15 which I believe if my appeal is not successful I will have to pay £100 unless I again appeal to POPLA. If NCP appeal is not successful I will again have to appeal with POPLA and all these takes so much time and just thinking, if its worth for £15.

liability or contractual agreement and I will be making a complaint about your

I contest and appeal this ‘parking charge’, on the grounds that you have
failed to comply with Schedule 4 of the Protection of Freedoms Act 2012; the
issue date of your PCN was 30 days later than the day after which the specified
period of parking ended, and not within 14 days as required in paragraph 9 of
the aforementioned Act. Therefore, keeper liability does not apply. There will
be no admissions as to who was driving, and no assumptions can be drawn.
You must also include a close up actual photograph of the sign that you
contend was at the location on the material date, including evidence that it
was properly illuminated on the date and time in question.

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner, Gatwick Airport Ltd, as well as to my local MP.
I contest and appeal this ‘parking charge’, on the grounds that you have failed to comply with Schedule 4 of the Protection of Freedoms Act 2012; the issue date of your PCN was 30 days later than the day after which the specified period of parking ended, and not within 14 days as required in paragraph 9 of the aforementioned Act. You must also include a close-up actual photograph of the sign that you contend was at the location on the material date, including evidence that it was properly illuminated on the date and time in question.
I will be complaining to the BPA and the DVLA about this because NCP have unlawfully obtained and processed my personal data.

I am aware that Sara Roberts, Head of AOS at the BPA is already investigating a formal complaint ref BPA-032489 about your sneaky little set up at Gatwick Airport, which breaches the BPA CoP due to (among other things such as your appalling signage and no method for people to actually pay before leaving if they do use the drop-off):
(a) failing to allow a consideration period, and
(b) issuing so-called parking charges to moving vehicles
Cancel the PCN as you have precisely zero hope at POPLA against a registered keeper where the driver is unidentified and the vehicle drove through without stopping. I will add my case to BPA-032489 if you don't.

Use the same wording if your circumstances are identical, although you haven't actually told us if that is the case so we have no idea if it was the same location and circumstances.

My circumstances are pretty much identical (didn't stop, 1 minute 6 secs, South Terminal rather than North Terminal) and wanted to know if:
a) it was okay to copy the OP's post in this thread and the addendum from @Coupon-mad word-for-word
b) if the addendum was still relevant (i.e. the case was ongoing and not resolved some how
I thought since my queries related to info in this thread it would be best to reply here rather then open a new thread, but sorry if this was a mistake.1
