Hi,
please can someone give me some assistance? I received a LBC from BW Legal regarding a supposed overstay on a retail park. I've since gone back through old diaries to figure out what happened...
I took my sons to a trampoline park based on a retail park. I arrived early so popped in to the Costa for a quick coffee before meeting friends. We then drove across to park in the parking area by the trampoline park. When you go to the trampoline park, you put your reg details on to an iPad for the parking. Kids bounced for a couple of hours then we go to leave! Upon leaving, kids decide they're hungry so we pop in to Pizza Hut which has its own parking 'area'.
fast forward 3 years and I get this random LBC from BW Legal. I honestly don't recall getting anything before this so it was a bit of a shock! So...off to google I go and I come across this fab forum. I've tried to follow all the steps advised in the Newbies thread. I sent a SAR and received this letter from Ipserv plus another letter with further info which you can only access by phoning a random mobile number! I'll upload a screen shot once they get back to me but I particularly wanted the info showing my reg on the records from the parking iPad in the trampoline park which they didn't include. All they had was a photo of my car arriving then leaving 3h 20m later (apparently you can only stay there for

I believe my next step is to complain to the retailer! The problem I have is that the trampoline park changed hands in lockdown so, whilst it is still a trampoline park, it has different owners! The Pizza Hut is now a Tim Hortons! Who do I complain to, what do I say and what is my next move?
Sorry if I've given too much info - I'm not a legal expert either so, whilst this might seem obvious if you know, I don't!

I assume BWLegal have added their normal fake charge ? (£60/£70) How do they explain this ?
Did you actually get debt recovery letters ?
Were you sent pictures of the signs prevailing at the time ?
Your next step is to find out who the landowner is who will probably be the same to get this cancelled2 -

Complain to the property agents who run the retail park. They are the ones who probably contracted IpServ.
You can find who that is by Googling the name of the retail park if it has one and looking for the agents who market the shop units.
Or maybe they are identified on a sign at the entrance (NOT Ipserv's sign). Or maybe you can find newspaper articles about people with a PCN and the journalist might have named either the landowner or the agent that runs the place.
Why didn't you get Ipserv's PCN and reminders? Was your car registered to an old address (sorted out now with the DVLA?).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you for responding. I have no idea if they added their fake charge! How do I find out? I think the initial letter I had was a letter before claim. I can't access the document from Ipserv as its password protected and you have to phone a mobile number to access which nobody answers?!I assume BWLegal have added their normal fake charge ? To be honest, I don't recall seeing any signs but you do need to log your registration when you go to the trampoline park. It seems like the land is owned by Ipswich Borough Assets (IBA). I have no idea why I didn't receive the original PCN. I can only assume they didn't send one or it got thrown away by my husband who usually opens mail (very doubtful). I doubt it would have been sent to an incorrect address to be honest. The only thing I am thinking is that my car used to be my husbands company car (registered to work address). When he changed his car, I bought the car off the company. Not sure when this process happened but I would have thought just before?! Either way I would have been driving it even if it was still in company name. Does that make sense?0 -
We are asking you to check the logbook address, assuming you still have the car. It's presumably never been changed, has it? That is why people don't get PCNs and are traced later by a debt collector or roboclaim solicitor.

I have now accessed the letter I received from Ipserv. I asked them to include the log from the trampoline park where they ask you to sign your car in but they haven't?! Surely the point of them asking you to do this is so that you don't have to go0 -
Vehicle ownership is irrelevant. What matters is whether the registered keeper's details are correct on the vehicle V5C.
Your real name and other personal data is showing on your posts above.
If your VRM was registered at the trampoline park, then that information should have been provided to you as a response to your SAR in the form of an extract from the log.
