  • Hello, further update and a question for help please.

    Have received the notice of allocation to the small claims track hearing. We are listed as the defendant with ukpc as the claimant. It states that the claimant needs to pay the trial fee of £27 by 10th May.

    Just checking that ukpc are responsible for paying this and not us as they are listed as the claimant…? Perhaps a stupid question but wanted to make sure. Will we be told if they have made the payment and it’s continuing?


    It also says we need to deliver all documents by the 20th May. Is this just another copy of the witness statement and photo images we already submitted. Do I need to add anything or what I have done before is it?

    Just for info we had the set aside meeting for the ccj to be removed and this is now the hearing for us to defend ourselves we didn’t get before when the ccj was served!

    No.

    Assume it is.  Yes it's their fee. Of course a defendant doesn't have to pay to have access to justice at a hearing.

    Re the WS, this depends if you already submitted a full WS and exhibits to fight the PCN?

    Most people at your stage have only submitted a more basic WS about setting aside the CCJ, with evidence of moving addresses.

  • Hello again, the solicitors rang my husband chasing a response to their offer to settle for a reduced sum and he told them we rejected the offer and offered they reimburse us for £245 fee to get the ccj set aside. She said she would speak to her client (she hadn’t seen our witness statement and evidence at this point)

    We have got an email with a notice of discontinuance to the court but how do I get my costs back if they have cancelled the claim???

    Depends what the Judge's Order said about costs when the CCJ was set aside?
