Anyone have any experience of taking Amazon UK to small claims court?

I ordered and paid £1399 for a 2022 Apple MacBook Pro 2 months ago and received a 2kg box of washing detergent instead. Having exhausted all attempts (emails and forms filled without number, obtaining a crime report from the police, returning item and sending proof they received it over a month ago etc) to get a resolution through their kafkaesque customer service dept I have concluded that my only option is to pursue them through the small claims court.

Does anyone have any experience of taking Amazon Uk through this process? I would love to hear about it before I begin the process

    How did you pay? If you used a card a sensible pre-court option would be to try a Chargeback or a S75 claim (the latter if it's a credit card).

    Sadly it was by debit card instead of credit card

    Whilst not a direct answer to you question, a few thoughts......

    Ultimately, assuming you sue the correct entity and it gets as far as a court hearing it will come down to who, on the balance of probabilities, the judge believes. Beyond your word as to what was in the parcel, what evidence do you have?

    Was the parcel's weight (which is usually clearly marked on the label) correct had it contained a the boxed Macbook?

    Was the Amazon box big enough to have contained the boxed Macbook?

    Was there any evidence that the parcel had been opened and re-sealed?

    Was the box of washing powder a type and size that could have been bought easily near you?

    Presumably nobody saw you open the box and find the wrong contents?

    Conclusive proof isn't needed, just any evidence that tips the balance of probability?

    I suspect many companies try and deflect such claims (and sadly some will be fraudulent) as far as possible, them most likely settle any their legal department feel are a close call rather than risk bad publicity.

    Although I doubt it’ll matter to you given the amount but it’s worth mentioning yourself and anyone associated with you will almost certainly lose their Amazon account.

    Have you returned the box of soap? If so then open a chargeback
