Tax codes... New employers

So my wife and I left the same employer in July where we had correct tax codes 
We got a P45 each and passed them to our new employer 
Her on 1275L me on 294l

We both started straight away with a new employer but I have a BR tax code, she has a 130t code

On our HMRC apps we have 2 jobs with codes showing in each

Ive told our employer to extract their digits or we will walk... 

They've had months to sort this

Who has responsibility for this, us, them or HMRC?

    You & HMRC.  The employer can only do what they are told to by HMRC.  Don't blame your employer for something that is outside their control. Speak to HMRC.

    Have you asked your new employer why they haven't used the tax code from the P45?

    Or did the new employer use the codes from the P45 and then HMRC issued different codes?

    I can't see any employer dreaming up a random 130T code of their own accord  :)

    A T code means that HMRC think you're still working in the old job as well as the new one and they've split your allowance between two employers.

    This COULD mean that HMRC have made a mistake, but the fact that this affects two people from the same employer suggests  that your former employer hasn't completed the process to make you a leaver properly and reported it to HMRC.  

    Your new employer can only apply the tax code they are given by HMRC.  Most payroll systems are automated with regard to tax codes now and when HMRC send the code it gets applied automatically.  What an employer cannot do, is pick an arbitrary code.  

    So you need to call HMRC yourself and sort this out and stop blaming your new employer for something that is entirely out of their control.

    Sounds like you're old employer hasn't processed you leaving the company....
  • he was pretty hot on the PAYE payroll thing, im sure he would have told HMRC a P45 had been raised, it was a fully automated system linked to HMRC

    You may find its a timing issue, if the new employer was quick off the mark reporting your first pay then HMRC might not have known you had left the old job at that point, hence the potential for them to think you have two ongoing jobs?
  • Well the facts are on the app, even the date I left the prior job.... 

    But says I've 2 tax codes...
