    I'm not sure whether they would 'wash', but you won't be able to find out without risking £275 - unless you would get help with fees. Do a Google search on 'help with court fees' for eligibility criteria. 

    They had 'up to six years' to issue a claim, and they did so within that timeframe. No one said it would take them six years to do so. 

    What about my question regarding the date of the Judgment Order?

    How does the court know I am in receipt of the claim, I did not see the claim letter until sometime last week. It says no the money claim site "A Judgment has been entered against you. You cannot respond to the claim at this time but you may apply for the judgment to be set aside."

    1. It's presumed delivered (by law) after 2 working days after the date of issue, but the court allows 5 days. Unless you've changed your address since the start of this claim, there's no scope. The fact that you admit to receiving the claim confirms this. Attempting to argue its non-receipt is not a road we'd recommend (ie, attempting to mislead the court). 

    2. Let's have the date of that entry on your MCOL history. The date due is usually one month from then. 

    3. Everyone has the option to set aside a Judgment, but unless you've got a watertight case for set aside, there is a financial risk in attempting to do so. Applying to set aside does not guarantee a positive outcome.

    I don't think you have a judgment notice yet.
    Shortly you will receive a Judgment for Claimant (in default) from the court which will give you a deadline to make a payment to the Claimant.
    Miss that deadline and suffer difficulties in obtaining credit for the next six years.

    Thanks for the guidance I received the Judgment for Claimant (in default) letter last week and paid in full

    My money claim account says:

    A claim was issued against you on 05/09/2023

    A judgment was issued against you on 03/10/2023 at 19:08:38

    Notification that you paid the claim on 12/10/2023 was received on 16/10/2023 at 19:24:57


    I have checked my credit file and it is showing on there will it be automatically removed or do I need to write to the court the information online isn't clear. I was under the impression this would not go onto my credit file until after the deadline.

    The commercial credit reference agencies tend to only update their files fortnightly.
    Your record should be clear soon.

    Just for the record, Registry Trust are notified of adverse Judgments immediately and adjust their records in a more timely manner.

    If you are concerned about things not progressing properly, pay the Registry Trust fee of £6.00 to see what they say about you.
