County Court Claim Form from DCB Legal

Hi All,

I was wondering if someone can help me.

I parked in a free car park in May 2019, however I received a parking charge notice for not displaying my mothers disabled badge. I had displayed the displayed the disabled badge, however as it was very windy that day when my mother and I opened the door to leave the car the disabled badge had fallen (you could still see the disabled badge at an angle but wasn’t in the pictures that the warden had taken).

When I received the parking ticket i contacted the company and appealed the fine via an online portal. The company responded in writing and asked to upload a picture of the disabled ticket however due to an online error I was unable to do so (I didn’t take a screen of the error). I then sent the picture of the disabled badge via post and received a response advising that I was out of time to make an appeal. 

I have since received a number of letters from collection companies claiming the debt and have written to a number of the companies except for 1 advising why I am disputing the debt as i parked in a free car park with a disabled passenger. I have now received a court claim pack 3 years later. I feel the reason why I have received the county court claim 3 years later is because I don’t have all the proof of postages as I have moved house and had a baby earlier this year. 

My question is the court claim pack is for £293.80 (amount claimed £208.80 plus court fee £35 and legal representation costs of £50).
If I defend and lose will the cost be higher? (Citizens advice were not sure)
Will I have to attend court it person, this will be very difficult as I have a baby?
If i defend and lose will I get a CCJ, as this will effect my future employment?

I’m very worried, my husband is advising to just pay the £293.80 but i am very upset about paying it as I could have just parked in any another parking space for free (there were plenty as it was just outside Dunelm) and I did have a disabled passenger with me who did have a valid disabled badge and we did attempt to display it correctly :-(

    What is the Issue Date on your County Court Claim Form?

    CAB are useless about private parking tickets.  Did they at least direct you to us here?

    If you lose, the cost would be LOWER (because the claim is exaggerated by £70) but you won't lose.

    No risk, no huge costs, no CCJ risked.

    No paying!

    What is the date of issue, top right on the claim?

    Did it arrive to your correct address?

    As it's DCBL.YOU ARE BEING SCAMMED, you DO NOT owe £293.80  ... DCBL add fake amounts. Nobody should ever pay a scammer

    Sounds like a UKPC claim. @Littlem1ss please take note of the following thread and read, then tell your husband that the forum is going to save you and him £293. Tell him you expect to be taken out for a nice meal as a result of the saving you've made (or have the central heating on for a couple of hours one evening!) 😄

  • Hi All,

    Yes the county court claim form did arrive at the correct address and was issued on the 12th October 2022.

    The parking company was UKPC and the claimant is “UK Parking Control Limited”.

    Citizens advice bureau just advised that I received the parking charge as I had parked in a disabled bay without displaying a disabled badge and that it is common for windy weather to move the badge without the owner of the vehicle realising and usually the parking ticket company would cancel the parking charge.

    Yes the county court claim form ... was issued on the 12th October 2022.

    With a Claim Issue Date of 12th October, you have until Monday 31st October to file an Acknowledgment of Service but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 14th November 2022 to file your Defence.
    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
