Charge received for 9 minutes parking

Hi. Hope somebody can help.

I've received a PCN for 9 minutes parking in a car park. I was unable to pay. The payment machines were not in working order and the sms number displayed on a sign which I texted replied to say that the service was no longer supported and to use an app to make payment, so I left the car park. I don't want to pay this. I think I should be allowed a grace period for the time it took me to realise that I couldn't pay. 

Advice appreciated.

    yes, you should not pay  - the charge is for parking - you didn't park, you stopped tried to pay but couldn't.

    What's the car park, and parking companies name on the invoice

    But when I googled I think it is actually Seed Street Car Park, Preston.

    Should be winnable at POPLA, as long as you supply the evidence you have, that you discovered that 2 out if the 3 ways to pay were not working and as soon as that was clear (and using a new app wasn't something they were comfortable to download) the driver left and parked elsewhere.

    Evidence of paying to park elsewhere is something POPLA like to see, as well as your 'attempt to pay' text and their auto-reply, and the timing on it.

    Did the PCN arrive at your house by day 14?

    Take a screenshot of outgoing calls/messages. If the events are relatively recent, you'll still have that info.

    I do have proof of payment elsewhere and the reply txt which I can screenshot. 

    Is my first port of call to appeal it at parkingeye and then reassess my options if they refuse my appeal?

    OK, so crack on as planned. Don't use the template appeal, just say what happened (the words I suggested earlier) and upload your evidence of trying to pay, then leaving and parking elsewhere.

    My appeal has been unsuccessful as they are, "not in receipt of sufficient evidence to confirm that the terms and conditions were not breached".

    Is it advised that I now turn to POPLA and use the same words and evidence as previous?
