    The point is that you've made a formal request under s77-9 CCA and they have not complied.

    Until they do, the debt is covered by subsection (4):

    If the creditor under an agreement fails to comply with subsection (1)

    (a) he is not entitled, while the default continues, to enforce the agreement;


    So it is now temporarily unenforceable but stays that way until they send you a copy of the agreement.

  • So I do nothing ? Wait 6 years ? No payments made ?

    You started off by asking about full & final settlement.

    You can still make one if you want to

    Or you can do nothing

    It's your choice, but you're now negotiating on an unenforceable debt
  • Just noticed on the statement it says to contact them for more information about the credit agreement should I ?

  • It’s literally the debt how much has been paid and o/s balance but refers to credit agreement taken out with Tesco but that’s not included?

    i did a cca request 5 years ago, they failed to send one, i havnt paid them a penny, in a years time it will be statute barred. unless they miraculously send one. In fact they havnt even sent me a letter or statement in over a year. I think they have so many "easy" clients to deal with. it doesnt even show on any credit report now, not sure why.

    Stupid questions maybe but how can an agreement be re-constructed if it cannot be found in its original form and also how can one be sure if a re-constructed agreement is infact a true reflection or just a generic thing to make it seem real.
