The thing with cca s77-9 unenforceability is that it's best viewed as temporary unenforceability - still useful for negotiating but can be enforceable again if they can reconstruct the paperwork to a judge's satisfaction.
Being unenforceable through being statute barred is the end of the journey - it's a complete defence should anyone be stupid enough to start a court claim.1 -
inminniesroom said:Thanks but the debt has been passed to PRA can I still get CCA ??
You don't actually want them to provide the CCA, you want them to be unable to find it after you request it, then the debt become unenforcable until they find it (which is hopefully never). The chance of them being unable to find it is higher with older debts and those that have been sold. It's a long game though as it doesn't become statute barred until 6 years after you stop acknolwdging it, and if they produce it in that time then it becomes enforcable again. If you are happy to hold out that long then it's well worth a go though (and it would be quite nice to see them admit its unenforcable after turning down your settlement offer!)
