  • I’ve got a DS1500. I’ve looked and I do get LCWRA but didn’t get it for the first 4 months. Total payment is £1414.58 (LCW std allowance and children) but £918.72 is taken away due to ESA and my wife earning £1316.85. So get £495.86.

    Sorry to hear of your situation.

    Do you have any money saved in a pension in your name?
    Does your wife have her own provision?
    Is it a DC pension i.e. a pot of money, or is it a scheme that provides specified benefits?
    Apologies if this sounds intrusive but is your prognosis such that a doctor might sign to say you have less than 12 months to live? (that specific timescale is pertinent to releasing funds from a pension).

    What I'm suggesting is that there might be an avenue to release money from your pension, subject to the scheme you have, your prognosis and of course provision for your wife and any other dependents.

    If the DS1500 was supplied at the start of the UC claim you should have been paid LCWRA from the start of the claim and you should challenge this. The normal waiting period does not apply to ‘Special Rules’ claims. 

    Obviously if the DS1500 was supplied later that would explain the delay.

  • Hi I’ve cashed my private pension in as a tax free lump sum, we’ve been making up the short fall every month with it, probably would have lost the house otherwise, mortgage, 3 daughters - one just finished Uni !!

    If your capital is over £6,000 has this been declared to UC. There is a reduction in your UC of £4.35/month for every £250, or part thereof, for capital over £6,000. If your capital is over £16,000 you are not entitled to any UC. What matters for UC purposes is what matters is the amount you have on the last day of your UC assessment period.

    Assuming the capital rules don’t prevent you getting UC, as mentioned in an earlier reply your wife should be claiming the carer element of UC for looking after you - it’s an extra £168/month.
