As he kept the house she doesn't want the deposit back as he can't pay it her anyway. It will be his inheritance. She just didn't want me to have her share all be it not legal. I agreed to £60k but had to get a mortgage on my own property as I didn't have enough to buy it. He borrowed £60k off her (which he also won't pay back) to give to me. What I meant by nothing sorry was he kept the house and pretty much everything in it. I've had to get into debt with a catalogue to buy kitchen appliances, sofas, beds everything. I pretty much came away with my possessions only aside from a coffee table and a couple of draws.Converted comper to MSE. Thank you for all your answers!0

The frustrating thing is when we met I was already living in a 2 bed house (council) but obviously had everything in it and he moved in with me from his parents at 24. It so angry I had to start all over again.Converted comper to MSE. Thank you for all your answers!0

OP, you say £220' house.
So is that a house valued at £220,000 or you have £220,000 equity in the house itself. The two are very different things.
You wouldn't expect to get half of £220,000 if there is still a lot of money owed to the bank.
If his mum did lend you (both) £70k then it's not morally unreasonable for her to have that figure back. Legally is another matter.

No valuation was done this was based on prices in the area of the same house at the time. He was originally only going to give me £30k but i fought for £60. Having to start afresh, I would not let him keep the value of the whole house but his mother will say it was split 3 ways, so fare, has your name been removed from land registry.
Landlords usually put all the rent through as expenses/mortgage, have you checked on LR that he actually owns them, not his mother or?
if he does own and they are rented out ask for a variation form, that makes them investigate and eventually to tribunal if no joy. Tribunal is really easy and straight forward not a court as such, where they go through his income.0 -
He owned them but I wouldn't put it past him to transfer them to his mom but he has to pay the bills on his house that was with me with something so i'm guessing he would have to be getting the rental income as he has no income form any other sources, Also he owns them and his house outright which would be a total of £370k in assets. My name had to be taken off the land registry of our house after I got the £60k so I could buy my house otherwise the stamp duty would have been more as it would have been considered a second home. Plus it was in the agreement that my name had to be taken off before money was handed over. Its all to late now as I took the £60k back in January along with my name coming off the deeds so there is nothing more I can do about that now. I was supposed to be moving into my house in the january but it fell through losing all my fees and moved into this one in the June so I had to stay there as basically a lodger until my house went though.
I was told the investigation could take months.
The old case they wrote off is currently with the local MP but being conservative I don't hold out much hope. She was also dealing with my backdated claim for UC but she said because I was to late claiming her hands were tied. I don't think they have much clout to be honest.Converted comper to MSE. He was getting loads of solicitors letters from a solicitor that was nothing to do with my transfer of deeds so I wondered what the reason for these were. At some point his mom was going to transfer her 2 into his name so he could have those also but I don't know if this was ever done.Converted comper to MSE. Thank you for all your answers!0

I would be asking for an explanation from CMS as to why they didn’t move forward with Sanctions action rather than writing off the debt. As the bailiffs were unsuccessful in collecting, they would have returned the case to CMS with a Nulla Bona document. This is the paperwork CMS need to include in a pack to the court when applying for sanctions action. This would have then brought him to court with a risk of losing either his Driving Licence or Passport or facing a prison sentence. I had to push massively for years for finally got my case to Sanctions earlier this year for about half the debt that was owed at the time. After ex messing the court about, he finally paid that portion in full about an hour before the hearing. Which had been adjourned and delayed twice.
if you haven’t already, I would be submitting a formal complaint about both parts of your case and confirming that if it’s not resolved to your satisfaction you will be taking the issues forward with ICE.
