Hi everyone,
The keeper of the vehicle has
received a Claim Form from Civil Enforcement Limited. The date of the claim is 22 September 2022 and
they are claiming:
- Amount claimed £186.02
- Court fee £35.00
- Legal rep costs £50
- Total amount £271.02
The keeper has read #2 of the NEWBIES post.
Supposedly,
the vehicle was parked on 18 August 2021 at Masala Bazaar, a grocery shop in Bristol, from 17:39 to 18:14:00.
A
1st letter for a " Parking Charge Due " was sent on the 23rd
of August 2021 for the usual demand to pay £60 within 14 days or £100
for the next 14 days.
After receiving the letter the keeper went to the shop and talked to the manager to get this resolved as the keeper had made a purchase there and didn't see the sign to enter the vehicle registration number after shopping. The manager took a copy of the PCN and told not to worry as he will be resolving it with the parking company. For the keeper this is the end of it. But unfortunately the issue was not resolved by the manager.
A 2nd one for a "Reminder Before Legal Action" was sent on the 14th of September 2021 for payment of £100.
A 3rd letter was sent on 08/10/2021 for "Action Needed" before escalation to £170 plus cost within 14 days.
A 4th letter was sent on 28/10/2021 for "Final Reminder" before escalation to £170 plus cost in 7 days.
A "Letter before action" was sent on 30/03/2022 for a debt of £170 and if not paid proceedings would be issued with a certain number of information including Standard Financial Statement ???, Court cases
A " Final Reminder Before Legal Action" was sent on 28/04/2022 for £170 to increased by £75 if no action taken.
All letters were ignored by the keeper.
A
SAR was sent to the PPC on 26 September 2022 with a bill as ID and the information was provided on 30th of September.
The keeper has contacted the manager to inform him of the situation. He call the PPC and they said nothing they can do and that the keeper needs to contact them. The keeper has tried with no luck.
An ASO was filled today 04/10/2022
The keeper believe this is the fault of the manager for not following the issue with the PPC. What do you guy think? How should the keeper proceed?

You have put too many specific details in your post, if Civil Enforcement look on this page they will know who you are due to time, date & location.
I would delete this thread & start another on the parking forum.1 -
Did the keeper advise the manager that he was getting further letters/reminders?Yanness said:Hi everyone,The keeper of the vehicle has received a Claim Form from Civil Enforcement Limited. The date of the claim is 22 September 2022 and they are claiming:- Amount claimed £186.02

Hi everyone,Continuing from the keeper's post above, is it advised to contact the PPC and ask them to drop the case as not the fault of the keeper but the manager? Is it advised to contact the manager to provide a letter telling the keeper has tried to resolved the issue through him/her? Is it going to matter to the judge?Thank you for your help guysLet's save money and God bless you:T.___________Private PCN issue? look for moneysavingexpert page, **NEWBIES!! I am going to assume...Yanness said:The keeper of the vehicle has received a Claim Form from Civil Enforcement Limited. The date of the claim is 22 September 2022An ASO was filled today 04/10/2022
a) the Issue Date on the Claim Form is 22nd September 2022, and
b) an Acknowledgment of Service was filed on 4th October 2022.
Please confirm. With a Claim Issue Date of 22nd September, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 25th October 2022 to file your Defence.
That's two weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.1 -

No, because they won't.Yanness said:Hi everyone,Continuing from the keeper's post above, is it advised to contact the PPC and ask them to drop the case as not the fault of the keeper but the manager? Is it advised to contact the manager to provide a letter telling the keeper has tried to resolved the issue through him/her? CEL are not known to be at all reasonable.
They are notorious ex-clampers whose 'Head of Legal' who signed your claim form was in the team responsible for the debacle that played out at defunct and disreputable failed loans company, WONGA. That's clearly his calibre...and given what we see from CEL they are acting in a similar vein with unfair terms and threatening demands with exaggerated 'fees'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
