    It does rather depend. If she can prove she sent it it won't be seen as fraud and you would then need to pay to take her to the small claims court.Again she might even have a defence if she can show you asked for it to be posted and that you didn't specify special delivery with proper insuarnce..it might be deemed that she sent it at your risk and not hers.

    If you are going to get anywhere with this you must be clearer when you talk to the police. You have made contradictory comments on here, you must make sure that you know exactly what happened and how things were sent.

    For instance you said yesterday in response to a question as to whether it was sent special or recorded:
    It is recorded Signed for,deffo for 100%. The ps3 would have had to be ina alarge box in order to post, she couldnt have got a recorded signed for label and just not posted the parcel? Something that big the RM would take from her after her getting the label?

    Its just i seen someone say you can purchase the Recorded signed for labels and post yourself.

    If it was sent special then it is trackable and if she has a tracking number she can show where item is, if it doesn't track she can claim her loss back from RM. Special would also indicate definitely whether item was sent or not.

    Did you pay extra for postage, if so how much?

    she told me that when she was posting it that she was sending it special delivery but after waiting over a week she finally admitted to not sending it. So thursday the 23rd came along and she said she posted it and then gave me the tracking number, but the tracking number is for recorded sign for so no use to me.

    Was in the police station 1 hour ago and they told me they cant help me.

    Cant believe someone can get away with taking someones money as easy as that.

    Yes it is easy to take someones money, however you can only scam someone who is naive enough to be scammed. With hindsight what did you think would happen once you transferred the money if the console didn't arrive, did you have any passing thoughts about the safety of the transaction at all?

    Anyway, whether or not this woman is a scam artist or just confused the advice is still the same. In the first instance try calling her again, you say you have full contact details so tell her console has not arrived and you would like to know how she is going to proceed with this. If she is difficult or evasive then send her a letter, recorded delivery stating that as you have not received any goods you have been advised by the police to take the matter to the small claims court.

    Give her a few days to digest that and then start small claims proceedings against her. It will cost you, I think it is currently £30, and you must have her full postal address to serve papers.

    You sound quite young in your posts and I know from my own boys that they tend to trust people more than I would. However, you must become more savvy to things otherwise this can happen again in many different ways, this was a fairly basic potential scam and you must always have the thought in the back of your mind whenever you do anything 'what happens if this goes wrong, wher eis my protection and what is my back up plan'. Only if you can answer all that should you ever proceed.

    So go and phone her now and start composing the stern letter (polite but firm) in case you need it.
