Here is an update. My partner received a "letter of claim" dated 9th March (we received it about 2 weeks after the date on the letter) from DCB legal. We replied via email within the time stipulated requesting a 30 day extension however we have now received a letter dated 11th April with a "claim form" from the county court business centre in Nottingham.
The bill is now £254.52So it looks like we will go to court. This is a bit disheartening given when I refused to pay these shark before I ended up in court and got my !!!!!! kicked.I'll now need to build a defence - so any assistance on cases I can study that are relevant to my case are most welcomeLet's beat these horrible people!!!!0 -
You mention 'a letter dated 11th April'.
Is that the Issue Date on your County Court Claim Form?2 -
There's no bill. And you won't pay anything. This is fully expected and exactly what you want because this is where you win.
The claim didn't come from Nottingham.
The claim will be discontinued after you get to your WS stage later this year (see the thread by @Umkomaas) so there will be no hearing.
Copy & adapt the defence by @Johny86 and also read the Template Defence thread for the first 12 steps including how to acknowledge the claim online, which is shown in a pictorial link.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This claim form is from a county court and has a "defence and counterclaim" form that I will fill in. I had asked for an additional 30 day period after we received the "letter of claim" but it is what it is.
I tried to see the thread by @Umkomaas however their account doesn't seem to exist anymore unfortunately.
I'll certainly look at the defence by @Johny86
I will post my defence when ready so otehrs can access it/benefit from it.
Many thanks once again0 -

Yes. Issue date is the 11th April 2023With a Claim Issue Date of 11th April, you have until Tuesday 2nd May to file an Acknowledgment of Service. Do not file an Acknowledgment of Service before 15th April, but otherwise there is nothing to be gained by delaying it.To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 15th May 2023 to file your Defence. That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.2 -

I have taken the liberty of producing the checklist as a pdf that you can print or keep handy throughout this process:

I'm still alive and kicking señor!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
