UKPC - Residents parking without permit

I've searched the forums but can only find people who were given a fine for residents parking on a property they lived in.

In my case, I received a parking charge for parking in a residents spot without a permit. I went through the initial appeal using the template from the FAQs, but now they're going to issue a POPLA code.

To reiterate, I did NOT have a permit, it was a completely empty car park outside a pub that had some residents parking spots and some public parking spots, I didn't notice that the one I had parked in was a residents spot. I have never referred to myself as the driver of the vehicle, only the keeper.

Is there any hope of me winning this appeal?

    The exact car park I was in is the one directly outside of "Harpsfield Hall Wetherspoons" in Hatfield.

    That view is from May this year so are you saying the paint has changed (just for my understanding) as, whilst i don't like the hybrid mess, it's quite obvious on the picture.

    Although you could park in the furthest right few 'residents bays' and walk to the shops without ever passing a sign.

    In the dark or bad visibility weather, it would be nigh on impossible to know because lines are easy to miss in bad light and must be accompanied by prominent signage too.

    Needs an extra sign on the right end of the run of residents' bays, otherwise those bays have no contactual terms at all.  The PPC know full well the direction shoppers will walk, and the lack of sign looks pretty deliberate.

    Have you looked on UKPC's website as if you are going to pay (but obviously don't) to see if there are any photos of the car showing that it is parked in a resident's bay?

    Whilst the bays say Resident's Bays, and are numbered, they do not contain the legend "only" therefore there is no indication that non-residents are prohibited from parking in those bays.

    What do the signs say about parking in resident's bays? As usual, UKPC's signs on the site are inadequate, fail to prominently display the charge for failing to comply with Ts and Cs, and fail to comply with the BPA's CoP.

    The paint on the floor has not changed, I missed the big residential letters, partly from my own oversight (the car park was completely empty and it just looks like a standard shopping car park) and the fact it was dark outside.

    Those bays have been marked as 'Residents Only' since well before the pub even existed.

    So in terms of a legitimate argument for me to win a dispute, I'd have to take the angle of there not being enough signage?
