Letter before Claim - Gladstones

Hi,

Hoping someone can help me please.  I've received a letter before claim from Gladstones saying I owe £170 for a parking charge a couple of years ago.  £100 for the original charge (increased from £60) then £70 added on by Gladstones. 

I requested a SAR from ParkWatch which I heard nothing back from however Gladstones have since sent across information which sent to my old address.

I've attached the images of the parking sign and images of me entering and leaving the car park in question, of which I was there for around 18 minutes - not in a bay.

Could someone advise on where I go from here please?  I've looked through the threads and I'm unable to find a template which would help get the £70 Gladstones charge removed which I believe from what I've read is illegal? 

Based on the sign attached, I'm assuming I have to pay the £100 fine now even though I didn't hear anything about the charge until recently as ParkWatch had been writing to me at my old address?

Any help or direction to links that anyone could give me in getting the charge reduced would be much appreciated.

    Eh? Why? NO PAYING ANYTHING!

    It's not a fine and you are merely at LBC stage. Perfectly normal stage and we win cases when defended at claim stage, which will come next.

    The falsely added £70 is not 'illegal'. It is likely to be 'unrecoverable' in court though, because it's an attempt at double recovery and Ministers called it 'extorting money from motorists'.

  • here's the letter received from Gladstones which was the first time I heard about the charge.  No idea why they were writing to my old address as my details were updated at the time of the house move

  • It was updated around the time of the move from memory.  Thanks for the info, just to make sure I have the right post... I need to go back to Gladstones with the below?  They have provided photos of me already so not sure how I can dispute this?

    Re PCN number:

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

  • I have the sign and it was permit holders only so I'm a bit unsure whether this template is relevant in this case?

    No, you took that from the first post of the NEWBIES thread, about 'appeal stage' when you first get a PCN. Irrelevant to you.

    Look at the vehicle's Registration Document (V5c).

    Look for the Doc Ref number. There is a date following it.

    On my V5c it's at the bottom of the second page in a box headed "Official use only. Do not write in this space".

    The first line format is an eleven digit Document Reference Number followed by a dd mm yy date.

    That is the date that your V5c was last updated.

    Thank you.  I was hoping for further advise please.  After receiving the 'Letter before claim' email from Gladstones.  I submitted my defence by email to CCBCAQ and also sent the Directions Questionnaire.  However, I've received an email back from them stating that I need to provide the full claim number and that they're unable to access my records without it.  Have I missed a stage in this process?  I've tried submitting using the original charge number and also the reference on the letter before claim from Gladstones but each time I've received notification from them stating it's incorrect.
