Stamp duty surcharge refund

My parents bought a replacement main home earlier this year and had to pay the stamp duty surcharge as they hadn't sold their old one. They did so a couple of months ago but are struggling to claim the surcharge refund from HMRC. They sent off the form about four weeks but have heard nothing since. I imagine HMRC aren't exactly staffed well at the moment and have their sights set on big sums but my parents would like their £12k back. How long do people think they will have to wait before they get a cheque in the post, what are other people's experiences of reclaiming this money?

  • Hi i was in a similar position my old property was sold on 2nd September, applied on 5th Sept for payment and received in my bank account on the 6th of September.   This was in Scotland

    Scotland is a completely separate tax (Land and Buildings Transaction Tax) operated by Revenue Scotland, so the timescales won’t compare.

    Tim_Q, when you say “struggling to claim” do you mean they have submitted their claim on form SDLT16 to HMRC by post but haven’t yet had a reply? A month isn’t all that long for a postal submission (just getting it scanned into the system takes time) but you could chase up progress by calling the SDLT helpline on 0300 200 3510.
