If so who are Ocean Parking?
I am still unclear as to whether the driver has been named to the ppc (see first post). In which case POFA is not valid.
I suggest you add to your PoPLA appeal regarding the drive through that by definition it is a place where people drive, not park. Terms and conditions of parking cannot possibly apply to driving/the drive-through area, so all time in the drive through must be deducted from time on site.
If the operator is to truly managing parking at this site, the ANPR car park entry camera should be situated at the exit of the drive-through area, or an additional camera installed at the end of the driver through area and the ANPR software set such that it automatically deducts time in drive through from time on site.

Coupon-mad said:I see no rationale as to why you say the NTK was non POFA. Either it is or it isn't but that depends on the wording on the NTK and/or the date it was served. And if you are right that it is non-POFA (is it?) then you must spell out the omissions in wording and/or the dates to POPLA.
And you signage stuff is good, except the driver DIDN'T encounter signage so don't put this!
"The driver encountered completely insufficient signage ."
Should I still remove that sentence with this in mind??0 -

This should only be done if the driver is better placed to deal with this than the keeper.
The keeper really should be the one posting here otherwise the advice given here will get lost in translation if we have to go through an uninvolved third party.
Plan A is always to complain to the landowner and McD's manager and/or CEO, and the keeper's MP.
If that fails, then all the points available from the third post of the NEWBIES should be used to create a PoPLA appeal. The draft should be shown here for checking before it is submitted.
If the keeper isn't sure if the NTK is or isn't PoFA complaint, they should post a redacted version here for the regulars to check. Leave all dates and location showing but redact personal information.
Get photos of the site and signage in readiness for a PoPLA appeal if Plan A fails.
And I mean it as no criticism of anyone, but it would probably take a good English reader all of those fifteen minutes to read and understand the sign before any queuing time is even considered.
Hint for next time: it looks to be two hours free parking at Tesco across the road?
Looks like there is a steady stream of McD's customers treading that route too. I count at least nine people here in this one image. One even has a McD's cup in his hand...

In my final hearing the rep said that I should have phoned the PPC. The judge said "where does it say in the contract to only enter the site if you are in possession of a mobile phone?".

The signage does not look up to much. There is a random sign attached to the same post at entry.
The car park seems ambiguous, There is an Indian restaurant to the left with two disabled spaces.

The car park is really ambiguous. There's also a hotel on site too. Prefect for car parking scammer this site. They know most people stay longer at McDonalds than 20 minutes. Blue Badge users, social workers, the lot have been scammed here.2 -
The driver did encounter signage at the point they left their vehicle to put rubbish in the bin and only at the point given the signing is so poor. It was at that point they became aware they could not pay by app and tried to phone the helpline, which no one answered. So, you should say the above instead. I would not use the word encountered.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If you can get into Walsall, I would take some photo's of the entrance showing that the signage is not visible on entry from the side that the driver entered the car park.
The photo's that you took of Backcester lane were instrumental in your success against Excel. Do the same with this claim.
Images can say more than the written word.
I think that the car park is very ambiguous. Where do they park for the Indian?

The signs are also quite high up. A short person (like myself) would struggle to read them. Those yellow signs are distracting and create noise. There is a yellow sign on the entrance. Two signs at the entrance are too much to process when driving.
