Windscreen PCN - gamble?

So I've read the newbie thread, and it says for a Windscreen PCN wait until day 25 and then appeal, and in essence this is in the hope that the appeal then causes them to mess up procedurally giving you a win at POPLA on a "technicality" because they've not sent the NTK...

My question is, if you're guilty and everything else appears to be compliant, are you then risking losing the discounted rate? As by the start of the appeal the charge will have increased from £60 to £100.

Sorry I couldn't find anything on the newbies thread or forum for this specific question.  :)

    Of course you are absolutely right.

    But that is only true if your statement "everything else appears to be compliant" is also true - i.e. not only 'appear' to be compliant, but actually are compliant.

  • Cheers for that - and yes I did see that bit, but wasn't sure how it would work if they rejected the appeal and you didn't want to proceed any further as surely they would accept £60 at that point?

  • It's UKPC. They are listed on the BPA website.

    I saw an old thread about them not being "authorised" with the DVLA to get keeper details, but then from more recent threads it seems they can get them again.

    Why wouldn't you want to proceed any further?

    it would help if you told us more about your situation, so you could be better advised. There are a few variables, so it would be better to receive advice based on your situation. 
  • Well it's the gamble of it all really, I've managed to successfully win at POPLA with an appeal in the past, but then my dad got a ticket and that one lost (so I'm still waiting to see if they end up progressing to court).

    Anyway, this particular case was for not being parked within the bay. Which is completely true. 

    Whilst I'd rather not pay the £60, I definitely don't want to pay £100. So currently just weighing up options, ie if the likelihood of winning at an appeal is low then I'd might as well pay the £60 now if the charge goes up to £100 after the appeal.

    Plus I've got a lot of stuff going on so I can't really dedicate hours to the parking ticket right now.

    If the driver ignores or the keeper appeals the NTD, then either the keeper will not receive a PoFA compliant NTK, meaning they will (should) win at PoPLA, or they will receive a PoFA complaint NTK. Either way the keeper will (should) be offered the same bribe for early payment that has already been offered to the driver.

    Depends how bad the parking was. I once advised my cousin to pay CEL at the discount because she'd parked across 2 bays like a numpty.  It was awful parking!

    But overlapping a line with one tyre, or parking in an UNMARKED place isn't an issue IMHO, and PPCs need to wind their necks in.

    And...the tactic of appealing on day 25 or 26 was developed especially for UKPC cases years ago, because they usually forget the NTK when they get over excited in their haste to dismiss any appeal and send out a rejection email.
