Sold a PS4 on Ebay now seller complaining

Recently sold a Playstation 4 on Ebay that had a faulty hard drive. I listed that it had a faulty hard drive, put for spares or repairs in the condition drop down menu and put it again in the listing description. The buyer has messaged me yesterday saying that the disk drive is faulty, but was working the last time I used it and only stopped using it as the hard drive broke.

Can they open a case against me for selling it with an undisclosed fault?

Yes - on eBay the buyer is unfortunately always right - unless you get lucky and they are a serial scam buyer in which case eBay might have removed their ability to open an INAD (item not as described) case. If I were you I would message the buyer apologising and say you will upload the pre paid return label for them to return the PS4 to you. I’m aware you might not want it back but in my experience over last couple decades on eBay most complaining buyers will go away when they realise you won’t just refund them and let them keep the item.  If they do return it then you get the opportunity to relist and sell to a less picky buyer (with all faults listed next time of course) Good luck.

Yes they can open a case but if your item specifics were clear and this was listed as spares and parts I would be straight onto eBay by phone and ask them to review the case and find in your favour. You do stand a good chance of winning if the item was clearly described .

So good they said it twice LOL - have to pitch in again and say that eBay almost never find in favour of the seller. Would recommend that you cut your losses and tell the buy to open the INAD case and that you are happy to accept return of the item. This way there is no mickey taking with a buyer trying to get a free PS4 off you. And you never know - the thought of having to repackage and get the PS4 back to your courier of choice might just make the buyer think twice and decide to keep the item and leave you alone.

  • Surely the OP listing it as spares or repair means he can tell them to do one......there is no chance I'd give them a refund bad feedback or not, eBay will find in sellers favour

Hear what you re saying but it’s unlikely eBay will find in seller’s favour as OP has acknowledged that there is a reported fault on the PS4 that was not mentioned on the original listing (appreciate that it may not have had this fault when seller listed it originally) .  There are also way too many buyers who will intentionally create or false report faults just to get something for free. EBay will just force the refund if buyer escalates.

  • In the item title I even put BROKEN. Surely broken means broken. I have already spent the money and can't afford to refund the buyer.
If I put something like "Apart from the hard drive fault, the console itself is fine" then that would imply there is only one fault with the console and that is the hard drive. Or because  I put hard drive fault in the description, have I basically said in so many words that the console is working fine apart from that one thing?

Really hope that eBay finds in your favour - honestly I do. Perhaps I’m too jaded after eBay never once found in my favour as a seller over the years. Please update and let us know how you get on. Just be mindful that if they find against you they can force the refund and even allow the buyer to get their money back AND in some cases keep the item. And it may also affect your future selling with eBay placing a hold on funds paid to you until your buyer leaves positive feedback/ confirms they are happy with the item you sent. Have seen it happen to too many good sellers on eBay.

Soolin has considerable experience of selling on Ebay and dealing with issues. I would strongly recommend following his advice and at least try to challenge this.

Yeah, I hope I might be lucky with this one! I've emailed the buyer saying that it clearly states for spairs or repairs and even had BROKEN in the title...he has not yet responded to this  :disappointed:

I will post updates as and when they arise  :)
