  • If someone does a Dro and a few smaller debts were not actually in default yet even though missed payments for a number of months, or some debts were not included in the application, then does it really make a difference?

    it seems the debt collectors don’t check or don’t care if they were included or not!

    but once you have done a DRO you just have to wait six years anyway right?

    From my understanding of the above and your questions
    Debts do not need to be defaulted to be included in a DRO
    Only debts that are decrlared as being in the DRO will be covered by it
    Other debts not included can still be persued by debt collectors
    IF debts that were included in the DRO arer chased in the future you simply send a copy of the DRO and debts that wee included, and that should be the end of the matter.  Keep all DRO related paperwork for at least 6 years from conclusion.

    Credit card debt - NIL
    Home improvement secured loans 30,130/41,000 and 23,156/28,000 End 2027 and 2029
    Mortgage 64,513/100,000 End Nov 2035
    2022 all rolling into new mortgage + extra to finish house. 125,000 End 2036

    can someone else confirm that it’s ok if the default date is after the DRO?

    but on the 6th anniversary the DRO will drop off but those defaults that were after may try to resume the debt?

    You are talking yourself around and around in circles with this, you really are.

    I posted on your other (similar) thread, so to clarify, and for the avoidance of any doubt -

    All your debts must be included in a DRO application.

    A debt does not initially have to be defaulted for DRO purposes, however, when it comes to credit file clean up time, after your DRO has ended, then all the accounts included in the DRO should show a default date no later than the start date of your DRO, the same as with bankruptcy.

    No debt included in a DRO should show as being defaulted any later than that date, ever.

    Sometimes you have to chase a creditor up to get your file marked correctly.

    Any debts that you missed, or forgot about, (which should not ever happen) will still be collectable, whether they are defaulted or not is immaterial, you will still be liable for a debt of this nature.

    I hope that clarifies the process for you once and for all.

    its interesting when anyone say “should”

    yes all debts should be included in the DRO and yes file clean up the creditors “should” alter the default dates post DRO.

    debt collection people “should” check these things but they never do
