Should I have got a POPLA code upon Appeal?

Hi,

A few months ago, I appealed a PCN with Private Parking Solutions Ltd using the template in the Newbies thread (Notice to Keeper).
I received a response from PPS, basically stating that the Keeper is still responsible. They did not approve or reject the appeal.

I had requested the POPLA code, but didn't receive one - Should I have?  Based on a previous post here, I would expect to win at appeal to POPLA, as the circumstances are very similar (though I was not driving).

Also - How will I know when I have a legitimate LBC / LBA?  I presume it would come from Gladstone or a law firm, rather than some debt collection agency?

Thanks

Is that Private Parking Solutions (London) Ltd?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

As they are a BPA AOS member, you should address a complaint to the BPA via their website 'Complaints' portal.

It will come from solicitors and will be headed up as such and give you 30 days to respond.  It will not come from a debt collector, but you're some way off any such action.

    Are you sure?

    PPS Ltd are not BPA.

    PPS (London) Ltd are.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Did they perhaps ask for the driver's details and give you extra time to supply that information?

If so, do not supply driver's info, but wait patiently for an appeal rejection.

    PPS Ltd are not BPA.

    PPS (London) Ltd are.

Just double checked, it's definitely "Private Parking Solutions (London) Ltd", who are a member of BPA. Is there a template for this, or anything specific worth mentioning?

They gave me 3 options, but no extra time:

    1. Give full details of driver
    2. Refuse to give details of driver, and therefore they pursure Keeper
    3. Submit appeal on behalf of driver - in which case, show proof they have nominated me to appeal on their behalf

Given the options, I did not reply.  At the time, I thought this was normal, but later realised I didn't get a POPLA code.

OK, so they have not yet refused your appeal.

They will refuse your appeal in due course when they realise that you are not going to respond to their request for driver's details.

Wait patiently for your appeal refusal with a PoPLA code.
  • It's been 6+ months.  Do they not have a time limit on refusing appeal and providing a code?

Have a look at the PCN on the PPC's website as if you are going to pay it and see what the status says. It is possible it was cancelled and you weren't told.

If it is still showing as active then you should have got a PoPLA code within 35 days. If you didn't then you should complain to the BPA.
