BW Legal spanked yesterday at Hereford County Court

BW Legal have been harassing me for almost 4 years on Behalf of Napier Parking for allegedly parking in an unauthorised place in a car park in Cornwall. £50 escalated to over £270. About 18 months ago they issued a claim to a different person who shares my name to an address I'd never heard of in the Midlands and wrote to me at my home to tell me so. I contacted them, told them they had made a mistake and they ignored me. Finally I had my day in Court. In their bundle they included a copy of the claim which was still in the other person's name at their address. I left it until a couple of days before and contacted the Court office to inform them of the mistake (which in a spirit of fairness, I had told B W about 18 months ago). The Court office had notified the Judge The District Judge threw it out before I could utter a word. Told BW Legal's rep that there was evidence I had notified them, it was in my witness statement and I had drawn the Court's attention to it. BW's rep tried to seek an adjournment to reissue. The Judge was having none of it, saying they had been aware of it for over a year. He said they were insulting the defendant (me), insulting the process and insulting the Judge himself and the Court and letting down their client as there would be on hearing. Case dismissed. 2 - 0 to me. Had em twice now. Had a bit of a hangover this morning.

  • No, The case never got off the ground, I did all my research poured over this and that and it came down to three pieces of paper. When I get the notification in writing I'll post it. Beat Cornwall Council at a tribunal 4 years ago, I'm getting a taste for this....

    Just another day in the office for a robo claimer dodgy legal and keyboard warrior
    You really should report them to the SRA for unreasonable behaviour

    You should have got costs for unreasonable behaviour

    Which court please and who was the judge. It would be nice to see the judgement when you receive it by post

    He should have awarded your costs though as there was no question this was unreasonable conduct.

    Please do come back and join us to comment to the DLUHC's upcoming Public Consultation about the level of parking charges and hopefully cementing the banning of the extortionate fake 'fees' spiral.

    I'm getting a taste for this....

    Come and join us and help advise others. It will enhance further your 'taste' for this. 

    Also, contribute to the next part of the Govt consultation (v3) on the level of the parking charge and the extortion that is the 'debt collection/administrative charge'.
