CCJ for parking fine

Hi all,
I know there is a 'newbie' post on here but I have read it so many times and i still do not understand so please help if you can.

I have recently find out I have a CCJ; I found this out by checking my credit report online. From calling the county court business centre they informed me it was from a parking fine 17 May 2021 and the CCJ was issued on the 15th June 2021. I went back to the parking place and saw the sign said this was PARKING EYE Ltd.

I have recently tried to get a mortgage and this is now preventing me from doing so. I was unaware of the parking fine as I had no fixed address and was staying at multiple peoples homes as my family home was not safe for me, the letters may have been sent to my family home where my car was registered but I dont know.

Please, what can I do?? I am willing to pay to have this removed as it will really affect my living situation. Any help would be amazing !! This type of stuff confuses me so a 'dumbed down' explanation for steps would be great.

Thank you!

When you looked at the NEWBIE sticky on the first page of the forum,
**NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? **READ THESE FAQS FIRST!** Thankyou!
did you find the second post starting thus: -

IF YOU HAVE A THREAD, REPLY ON IT, DON'T START A NEW ONE
and scroll down until you found the section about CCJ: -
HAVE YOU FOUND OUT ABOUT A CCJ (JUDGMENT FOR CLAIMANT) AND NEED IT SET ASIDE?
Then did you follow the link to a case which is well documented (admittedly there are several (?) pages but worth a read: -

Why not just read a few recent CCJ set aside threads, with answers, advice and replies that show exactly what a person in your shoes just did from scratch, thanks to this forum?

    E.g. the thread by @Brokenchief

  • You cannot have been issued with a ‘parking fine’ in May 21 and a CCJ in June 21. More like the hearing was in May and you had 28 days to pay it. Simply paying the CCJ will result in it being marked as satisfied but it will still be on your record and impact your ability to access any finance.

You need to find out more details of the PCN from Parking Eye and begin the process soon of requesting that the judgment be set aside if the claim was issued to the wrong address. It will cost £245 to apply to the court. If you have evidence ‘you were there to be found’ at an alternative address your prospects of a mandatory set aside are good

There was no hearing. This will be a default CCJ - entirely automatic.

You cannot have been issued with a ‘parking fine’ in May 21 and a CCJ in June 21.

But if a County Court Claim was issued in May 2021, then a Default Judgment in June 2021 is understandable.

My credit report says the case was heard 15th June 2021. I called County court business centre (from information on my credit report) and they told me the day of the parking was 17th May 2021 which was at a dominos and the parking company is Parkin Eye.

however from checking my bank statement it actually says 22nd May 2021 is when I purchased the dominos and thus would have been parked there.

I have not had any contact with parking eye. I don’t have any original letters about this charge with dates or times from them

Shall I email parking eye for information? Or call the business centre back. As I’m sure I’ve read don’t have contact with parking eye especially via telephone.

    (Thank you for your response)

My credit report says case heard 15 June 2021. And when I called county court business centre they said the same.

Those dates don't make any sense and need checking.  Email ParkingEye:

    enforcement@parkingeye.co.uk

Also ask them which address the claim went to and when, and did they carry out a soft trace first before filing the claim?  Did it not return any other addresses?

There was never a hearing.  Don't use the word 'heard'. or hearing'.

Please stop calling this a parking fine, it is no such thing.

    Did you receive any documents?
     if not why not?

Paying it off will/may ( depending upon the timings) result in it remaining on your credit file, and having a negative effect for the next 6 years , so again depending upon the timings you need to look at getting it set aside- this will depend upon why / if you didn't receive any documentation.
