    Well OPS don't have facial recognition and nor do POPLA. So the keeper can still appeal as keeper and talk about the late service of the NTK and the lack of a 5 minute grace period.

    You are overthinking this.

    Appeal as keeper using the template in blue text. Add a one liner that it was posted second class on 26/8 date, arrived on 2/9 which was day 15 and therefore too late for keeper liability to apply. You could include a copy of the envelope to show it was posted second class, or you could save that and the interpretation act etcetera for PoPLA.
