    I'm ok on the scottish law bit i have read all the booklets from the accountant in bankruptcy about 5 times now (all 10 of them) its the support bit i'm lacking, so big thanks from me

    Charge for Payment is not automatic, sometimes creditors don't bother as it costs to apply to the court and for serving by Sheriff Officers. With the one year coming in next year it is also increasing the amount of debt you have to be in to £3000 but there is a no asset low income sequestration thing coming in which will make things more straightforward. If you have a look at the policy bit on the www.aib.gov.uk there is more information there.

    If you contact the Citizens Advice in Scotland or the Money Advisers at the council they may know of a Bankruptcy Advice group in the area as there are recognised groups in some areas where people are willing to give advice to other bankrupts about things that may happen/have happened and they have loads of information.

    sorry to hi-jack this threadhomework- what happens if no one issues a charge for payment does that mean it is impossible to go bankrupt. Have spoken to cab adviser he thinks we will get a charge for payment but it may take sometime.thanks

    If you have the agreement of a creditor you can go bankrupt with concurrence, it is a different petition you complete. If you have been in a trust deed and fail to keep to the agreement the company will mke you bankrupt or may allow you to go bankrupt on a debtors petititon.

    Otherwise it is a wait for a charge for payment. There are lots of people waiting for them to go bankrupt but it is up to the company if they wish to incur the expense of issuing one.
  • Hi. Just an update.

    As I got paid on Friday, I changed my SO to pay my rent payment on the same day, rather than count on it still being in my account on 1st Jan (it wouldn't have been!).

    I emailed my agency to let them know and because it was from a different account to usual, I asked them could they please let me know when they get it (one less thing to worry about).

    I got a reply to say that "we wish all our tenants were like you". Hopefully even if the OR decides to mention it to the agency, that means that they would rather have me BR and paying my rent rather than kick me out and take a chance on someone who may not pay.

    Feeling more hopeful now :)

    Yep, I agree with BLTN. It does sound good and your letting agency sound reasonable, sending you nice letters and everything!

    I've only just looked at this thread, but I had exactly the same worries as yourself regarding tenancy b4 I went BR (I am a fellow worrier of sorts), I'm slightly different as I've been on housing benefit, but the ends are exactly same, in that, the rent has been payed upto the point of BR, why should that change now?! If anything it will be easier to pay after the BR!!

    I agree with what the more experienced members of the 'MSE' have said (musn't get above my station, only did my first post 2 days ago, don't want to come across as all Charlie Big Spuds!!!:smiley: ), why would they kick out a reliable payer just because they've gone BR??? ;) Hang in there Brother!

    Might see you in the Bankrupt Inn tomorrow:beer: . I'm a brand newbie and I've never been in before, so It might take me a while to find the bar!!!!!!!!!!:D :D
