Tenancy???

Hi

Have just read my tenancy agreement and it says that "We may repossess the property if you become bankrupt".

Does this mean that I can't do it?

I'm up to date with my rent and will continue to be so as it's the very first thing that comes out of my account after I get paid.

This place is furnished - if I get kicked out of here I will have absolutely nothing and I'm sure the beloved Leeds City Council will reckon I've made myself intentionally homeless. I don't have any family in Leeds so I'd have nowhere to go (Wonder_Girl - crashing on your sofa is not an answer!).

I've read other posts that suggest the OR doesn't have to inform your LL but may do even if you ask them not to.

Just as I'm starting to have hope...

  • The operative word here is MAY. `They have to give you notice to quit which would give you time to find a new place. You do know that they could ask you to quit with 2 months notice anyway.

    But you don't owe them anything, you have always been a good reliable tenant and if they got rid of you they could get a nightmare tennant.

    Ask the OR not to tell LL. Give him rent statement and rent contract and hope. If they do tell them then appeal to their better nature as above.

    I think this clause tends to be put in for those who are behind in their rent.

  • Squirrel, try not to worry (hard i know, i did the same before br) but i asked/begged my OR not to inform my LL and he didn't. Thankfully the Ll lives out of town so wouldn't have seen the local paper.
    All you can do is keep your head down, beg the OR and then, if push comes to shove, bed the LL.
    I've seen a lot of posts on here from people who have told the LL or the LL has found out and none so far have been chucked out of their homes.

    Nothing to worry about Squirrel,

    The important word here is "may". If you're up to date with your rent it won't be a problem. It's just a clause to get around the minimum notice landlords have to give their tennants if they use bankruptcy to avoid paying the rent.

    We rented as bankrupts and its cash in their sweaty palms that counts; nothing more; no problem.

    squirrel_pigeon Do you get on with your landlord? I had the same on my tenancy agreement, I spoke to my landlord and explained the situation to him before I went BR, now he is a reasonable man, so he was alright with me over it, I don't know what the law says on it, but as far as we determined its down the the judgement of the landlord, he also told me that another of his tenants had gone BR 18 months ago and was still living in his property!! Give the citizens advice a call tomorrow, they will be able to put you right, unless someone else knows more than I do... which they probably will, clever round here they are ;)

  • Thanks - I was counting on 'may' being the operative word. My LLs (the agency) are ok - the tenancy agreement says that if I lost my keys they would charge me £40 but when I had my bag (and EVERYTHING in it) stolen they just gave me a new set. They're a bit lax when it comes to fixing leaks etc but they get round to it eventually.

    DD has added some 'artwork' to her bedroom wall so may repaint before going BR just incase they come round to talk to me.... :)

    I have to say bltn, we were that desperate at one time that I would have bedded the landlord.:eek: :eek: And he was pushing 60yrs old, in the RAF and sporting a handlebar moustache.:eek: :eek: :eek:
