Double dipping and failed the appeal to IAS

I am sorry that I have to start a new post which seems that very popular. However, I still cannot find any similar case to me.
I have relocated to the UK for about 1 year and not really familiar with the rules and laws of the UK. I did receive a PCN in June 2022 which charged me ‘Vehicle not permitted & grace period exceeded’ during 13:13:28-13:48:20 on 28 May 2022. The reason why I did not purchase the parking session was because I entered the car park(no barrier) at 13:13 and found that no parking space available, then I left in few minutes. I re-entered the carpark to look for the space again at around 13:4x and left at 13:48 because the carpark was still fully occupied. I appealed to the PPC at first without any proof as the videos in my dashcam had been overwritten and I thought that they should make careless mistake. Of course the result was lost and then I appealed to IAS and with the travel record this time because I just realized that my car had been installed a telematic box by my car insurance company. I captured the travel record of my car from the portal to show that my car was moving but not parking during 13:13-13:48. Again they just replied me rubbish reasons how the PCN was reasonably issued. During the period of appeal, I did request the insurance company issued an official copy of my travel record on that day. However, they gave me an email after the due date of proof submission. I sent the official email to the PPC again but they simply replied me they are unable to look at the matter again. Now the PCN has been incurred to £160, I did contact my MP before with the official email from the insurance company, however, he sent me the reponse from PPC that they had captured the photos I entered and left the premise at 13:13 and 13:48 repectively and he seems not willing to follow anymore. I have copied the official email from my car insurance company as follow:

Please find below, a brief breakdown of the vehicle with registration number xxxxxxx movements during the mentioned time window on the 28/05/2022.

At 13:13:16 the vehicle with registration number xxxxxxxx was at 52.47311 -1.89852 (the carpark in question - Essex Street).

At 13:14:16 the vehicle with registration number xxxxxxxx had left the carpark and was at 52.47235 -1.89873 (Bromsgrove Street).

The vehicle with registration number xxxxxxxx then continued driving until 13:26:16, when they parked at 52.47785 -1.90111 (Hill Street) until 13:34:16.

The vehicle with registration number xxxxxxxx with xxx as the driver then resumed driving and eventually at 13:48:12 they returned to 52.47305 -1.89848 (the carpark in question - Essex Street) where they circled the carpark for 7 mins before leaving again. This is evident as at 13:55:12 the PH was at 52.47363 -1.89848 (Inge Street, ? near carpark) and they continued driving until 14:04, parking elsewhere.

The location and time did not completely match with the record of PPC as I had entered the carpark 3 times actually and the last time record was 13:54-13:57 (from PPC). My question is what is my next step to do under this situation? Is the official email from my insurance company strong enough to put me win if PPC takes the case to small claim court? Do I have to send SAR at this stage? I really need your advices. Thank you.

    Do you have Google Maps on your phone?  If you do and you check your timeline it will show all the places and times you were there.

    Which parking firm?

    You do know that an appeal rejected by the IAS does not mean you have to pay? Only a Judge can instruct you to pay, not the IAS, not the parking firm, not any of their slimy debt collectors - none of them!
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • The evidence from your black box and insurance company would demonstrate to a judge they are trying to scam you. Don’t pay but send the PPC a SAR and request they check and provide you with all the images of your car including the orphan images they haven’t bothered to look for showing you left promptly and returned later. The ANPR system automatically using first and last images. They don’t bother checking for other images even when informed of more than one visit because that earns them nothing.

    You should realise that you are dealing with greedy scammers out to extort money from you what ever you put in your appeal would be rejected, this has nothing what so ever to do with "with the rules and laws of the UK."

    How about taking this to your local newspaper - they will love it due to your evidence, and the PPC will cancel.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Thank you for your reply. I have drafted the letter by using the template in newbies thread. I have checked their privacy statement and they only accept SAR by post. Should I send them email as well?

    Absolutely I will do it if it happened in my home town but now I am not sure how to approach the local newspaper. Would you please give me some suggestions? Thank you.
