Sky Broadband House Move

Hi Guys,

I hope you're well.

I'm currently on Sky broadband and 6 months into an 18-month contract. I am moving to a new property and the speed is much slower at the new property than what I'm on now. Does anybody know if I can get out of my existing contract given the speed is not the same as my original agreement?

Any Guidance would be greatly appreciated.

    Generally, you've signed up for 18 months at your present address and if you have decided to move house then SKY is entitled to recover the whole of the rest of the agreement which is effective around 12 months worth.

    However, they are usually willing to waive that right if you takeout a new contract at the new address, they don't have to, but they generally do. Should you decide to go with another provider at your new address then they can invoke the early termination fee. It's not their fault that you've decided to move, neither is it within their power to provide you with the same speeds.

    Would you have been willing to pay them more if the speeds had been greater than those you are presently enjoying

    What makes you think that moving to another provider will give you a better speed?

    Sky is clear that, if the existing product is available at the new address, the contract continues at the new address.

    Clause 4:
    Changing your Address and telephone number
    (a) You must tell us immediately of any changes to your Address or the telephone numbers you have provided to us. We recommend that you provide us with at least 2 weeks’ notice of your change of Address. $(b) If you change Address:
    (i) This Contract will continue unless you exercise a right to end it under this Contract.
    (ii) If any Product which you are subscribing to is not available at your new Address you may either end this Contract or select another Product that is available there in which case this Contract will continue.
    (c) We may charge you a reasonable administration fee for transferring your service to your new Address. We will tell you whether a charge applies and the amount before processing your move but you can also see whether we currently charge for transferring services at www.sky.com/help/articles/moving-home-faqs 
    Clause 10:
    (c) You can end this Contract without incurring early termination charges during your Minimum Term if:
    ...
    (iii) Condition 4(b)(ii) applies (you are moving home and the Product you are subscribing to is not available at your new Address);
