Adice needed plzzzzzzzz

hi all just need sum advice , ive got an account wiv n/wide my wages were paid into this account but then i changed jobs and no longer had them paid into this account, now to cut a long story short of how i owe them £287.00 now it has gone to a debt collection even tho i have asked n/w for over £1,000 back dues to charges , but they said no they werent giving me nothing back,so now i have just recieved a letter on saturday saying ive gone to the debt agency and need to phone to offer a payment , now i think i should fone and say im not paying nothing cos u owe me more than £287 in charges and wait till after the test case or should i just pay a bit of at a time , i know that if i do pay sum thing of and the banks do have to pay us our money back then i will get all of the £1,000 back instead of taking the £287 of hope this makes sense cheers all jill

    Begin a claim for what they owe you, pay the debt collectors NOTHING, ask them for a copy of the CCA and remind them that the "debt" is currently in dispute and that you will counter claim for damages & harrassment if they harrass you for the money. Keep a log of all correspondence from them.

    hi smasher at this moment it time cant afford to do mcol, but i will ring them to morrow and see wot they say thanks very much for the info jill

    hi smasher and all , just phoned roxburghe debt collections , the lady said she doesnt have a copy of the cca , and i told her i will not be paying the amount as its in dispute , she said she will record this and then wait and see wot nationwide say , well least its a start , thanks for the info jill

    That is good news Johnny, however you MUST ask for it in writing and send a fee of one pound.. Then they have 21 days in which to send it. If they don't you can ignore them..

    hi smasher do u mean write to nationwide or the debt recovery , never done this b4 so bit confused lol so all i do is ask for a cca and send a cheque for a pound cheers jill

    Ask for a copy of the original CCA, send it to the debt collection agency.
  • hi guys need ur help again, the first letter i got from the debt collection agency i foned up and said it was in dispute, they have now got back to me to day wiv a 72 hour notice saying they taking me to court , so i phoned this morning and spoke to a guy who said it was sent back to n/wide saying i dispute i owe them money , he then said n/wide told the debt collectors to get the money , so he said as a 1 of payment can i pay £175.00 in a lump sum and that will be the end of it , i did say that n/wide owe me over a £1,000 so y should i pay u that money when u owe me , and if i take u to court mine will be put on stay cos of the test case, he said y dont u just pay it then when the test case is over i will get all of it back , he said the debt is now wiv a solictor so i have till the 31st of jan to either pay a one of sum or £175 or pay monthly ,if i pay monthly i will have to pay all of it , so im thinking on the 31st when i get paid do mcol , so does any 1 know where i will stand if i take them to court could there solictor still persue me for the money cheers jill

    First of all don't offer them nothing.Download a budget sheet and see what you have left.
