    You were absolutely in the right and had the moral high ground and then rang up, got intimidated and handed it to them. I think they could paint your refusal to go ahead with what you agreed, as unreasonable conduct.

    You paid £120 on that verbal agreement and agreed to pay £108 x 2 court fees on top, to make it go away, and now you are reneging on that agreement and refusing to sign what will be painted as a 'perfectly reasonable' consent Order based on a discussion on the phone to resolve the matter.

  • I did exactly the same thing last time in 2020 i blind panicked and paid the PCN charge! They again sent a draft order which stated exactly the same thing and i ignored that as well as i wasn't paying anymore

  • I know! im kicking myself....very panicked and stressed mum with 2 small children running round whilst trying to talk to someone who clearly only wants money for 2 offenses that haven't even been proven! No more stress is needed But thank you both for your help and input ill hopefully have the email drafted by the morning

    On what basis will you be able to oppose an agreement that you verbally accepted and paid for?  I am so sorry, I think this set aside application is possibly doomed or at least, on shakier ground now.

    What happened in the end in 2020, did you refuse to sign and instead went ahead and got that CCJ set aside by paying a £275 court fee - or did you just do nothing and still have that CCJ too?  Trying to work out what happened with that first one.

    Hopefully duress - acting under fear not consent

    But I clearly remember contracts entered into under duress are avoidable
