hi all I'm finding it hard to know exactly what to write in points 2 & 3
I honestly don't know who was driving and have no idea why I would have entered or used the car park as I live around the corner. I don't recall if the signs at the time in 2017 were obscured or not
If anyone can help me add anything to what I have written below that would be great! The facts as known to the Defendant:
2. It is admitted that the Defendant was the registered keeper of the vehicle in question at the time.
- the Defendant does not know who was driving the vehicle on a random day in 2017
3. The Defendant can not remember any reason why they would have used the car park in question0 -
Just copy a Highview one. All of them cover this situation in 2022 & used standard wording.
I know yours isn't Highview. Doesn't matter.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

When you started this thread you had over two weeks to create a Defence.
You now have two days left.0 -
I would replace the word random in your para 2 with unremarkable.
You could add this as well.
3. The Defendant can not remember any reason why they would have used the car park in question, and therefore on the balance of probabilities was not the driver at the material time.

thanks for all the responses! I'll be submitting it today. Just to clarify from what I've read I should not use moneyclaim.gov website to file my defence?

Do you really need clarification?smooth1 said:Just to clarify from what I've read I should not use moneyclaim.gov website to file my defence?
On 29 August at 10:10PM I wrote on your very own thread...Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.If that was wrong, I can assure you that someone would've challenged it at some time in the last two weeks.
When filing your Defence, make sure you get an automated email receipt. Defences often seem to 'vanish' when filed over a weekend, so it might be best to file your Defence tomorrow during working hours.

apologies I should have re-read the thread
when I send the email to CCBCAQ@Justice.gov.uk I won't be able to scan it so would a word document attachment be okay?0 -
Perhaps you could photograph your signature on a plain white piece of paper and include that image in your Word document at the appropriate place.
Then in Word, save that document as a PDF and send it to the CCBC as described in the opening post of the template Defence thread.0 -
A word doc is of course not OK because it can be altered.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
