Hi all,
I was wondering if anyone could help me with this, I have had a read-over of some threads and have now filed an AOS to allow me an extra 14 days before I submit my defence. ( letter from court is dated 10th August )
Am I right in thinking my defence is pretty much a copy / paste ?
The fine is dating back to 2017, I never once responded to them and quite frankly I did not think it would escalate to this point (with extra fees) - they state the same jargon that has been posted in previous threads 'agreed to park etc'
if anyone can link exactly what I should submit for my defence I would really apprecate it
Also, would the total claim cost increase if it goes any further?

What is the Issue Date on your County Court Claim Form?
Upon what date did you file an Acknowledgment of Service?
Your MCOL Claim History will have the definitive answer to that.

Did the claim come via one of the dodgy fantasy legals, WHO ?
Fake add-ons is the fantasy scam which you don't owe
If it ends up in court there are just a court fee and legal costs which are capped.1 -
If you go to the first page of the parking sub-forum you will see a thread/discussion starting "Template defence to adapt....."
Go to the first post of that thread and scroll down to find the template, adjust paragraphs 2 & 3 to suit your circumstances and follow the instructions in the template defence thread to send by e-mail to the CCBC. The regular who posted above @KeithPwill give you some dates and a link to the defence. If you like you can post your amended paragraphs (only) here for critique.

With a Claim Issue Date of 10th August, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 12th September 2022 to file your Defence.
That's almost two weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.2 -

What happened when you complained to the landowner and your MP? That is always Plan A.
If you haven't already done so, you should send an SAR as per the advice in the NEWBIES to the PPC. The response won't be back in time to help with your defence, but it will help at the witness statement/evidence/exhibits stage.
If you were not driving at the time of the alleged event, or do not know who was driving on an unremarkable day seven years ago, then say so in your defence. If you were not driving, or you genuinely do not know who was driving, and the NTK was not PoFA compliant, then the keeper cannot be held liable.
Do however bear in mind what you would say under oath if the judge asks you if you were driving. A non PoFA compliant only helps the keeper if they were not the driver.
