Have you read this thread before you pay them?

Because you'll definitely be kicking yourself if you read it after you pay them!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

If their proforma for appeals doesn't allow anyone to submit an appeal without clicking a box to say they are a driver,  I'd suggest that it's not evidence of anything.

I would suggest that only the keeper can complete a pofa declaration to transfer liability,  so C has chosen not availed themselves of that option.

They cannot sue you as a keeper.  The quality of the witness evidence relied upon will be key.  Ideally the o/p will not be insured on the GFs car.

    @johnersh that isnt actually correct

If a notice to keeper is received, the keeper passes the notice to the driver, the driver then appeals and states they were driving(along with their appeal) liability is then transferred to the driver, as the parking company now know the driver details along with their address etc
    This is very common

This makes for interesting reading. If I understand correctly, this is the pattern that UKPC / DCB Legal are almost always following (by default) before then dropping the case anyway?

I suppose I just have to weigh up whether or not I want this hassle.

The hassle of copy and paste?

BBC WatchDog “if you are struggling with an unfair parking charge do get in touch”

Please email your PCN story to watchdog@bbc.co.uk they want to hear about it.
Please then tell us here that you have done so.

@Grizebeck but is the online proforma actually and explicitly making clear that completion of the online appeal form is to transfer liability?
Because if it is not, I am not convinced that they are the same thing or that it automatically operates to do so.  I have not seen the typical web template, so happy to defer on the point.

If the o/p has been a wally and completed a transfer declaration in error then it is probably only the original keeper that can rescue that at this point.

There are quite a few different forms amongst the companies
But by someone saying they are the driver automatically puts the liability on them.

Well they claimed that they ditched UKPC in favour of UK CPM in order to “improve the parking service”, but clearly it was cost-based decision.
No.  They both operate free.  Same MO.  These firms have to invent reasons to issue PCNs or they make no money.

But yes, I always assumed the estate management company were effectively "on commission" from these parking firms...
"We'll pay you X for every ticket we issue, if you let us operate on the land."
Quite possibly that is a factor!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
