    Sounds like he needs more lessons and another driving test. Shouldn't be in possession of a driving licence at the moment.

    Really? I have never known such an occurrence. In fact it could be argued that it is an abuse of process. Whilst there is no entitlement to a course, once one is offered, along with the promise that no other action (either out-of-court or prosecution) would take place provided the course was paid for and taken in the required timescale, it would be perverse to withdraw that offer simply on the basis that a second offence had been committed.
    I only quoted direct from the Met website although others use the same/similar wording. I've only known one (anecdotal) case where someone was charged with a more serious driving offence and the SAC was rescinded and a fixed penalty offered ensuring the driver was banned under totting up. I'm sure it's not a regular occurrence but not sure it can be classed as abuse of process. Not sure whether on the paperwork accepting an SAC it highlights the chance it could be rescinded and you accept it on this basis

    35mph and 39mph in a 30! Perhaps dial down the "shouldn't have a licence" "needs another test" comments. But, of course, to get a 3rd would likely be quite a problem.
