Parking fine

I’m sorry if I’m doing this all wrong, I’m new here. I’m trying to help my brother after he received a parking charge from Smart Parking Ltd.

A couple of weeks he parked in Hoyland (Barnsley) market car park for 14 minutes. He’s disabled (end stage renal failure + mobility issues) and parked in the blue badge bay. It’s been a while since he went there and the last he knew it was a council car park and was free. Turns out it wasn’t, it was sold a couple of years ago to a private company. I’ve got mixed info online, one place says 1st hour is free, another says it’s £1 an hour. But anyway, he parked thinking the council still owned it, put his blue badge in. Then left 14 mins later.

He’s just got a letter saying it’s a charge of £60 and he’s distraught. £60 is quite literally half his weekly income. I said I’d look on line for help and google led me here. Is there anything we can do?

    Smart Parking charges are very easy to deal with.  Simply use the blue text initial appeal template found in the NEWBIES FAQ Announcement, first post. As Smart Parking do not use the Protection of Freedoms Act 2012 (Schedule 4) to hold the vehicle keeper liable, provided there is no mention to them of who the driver was, just add this sentence to the end of the initial appeal. 

    'As your Notice to Keeper does not comply with the strict requirements of the Protection of Freedoms Act 2012 (Schedule 4), and as the Registered Keeper of this vehicle I have no liability for this charge, you should immediately cancel the charge and confirm that you have done so.'

    Remember, this must be done in your brother's name. You must not get involved in appealing 'on behalf of'. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    It is absolutely imperative that the driver's identity is not revealed. The Keeper should send the appeal template in blue text from the NEWBIES, unaltered, except for the addition of the extra paragraph advised above.

    Hope? It's 100% winnable as long as he does NOT tick driver on the appeal page.

    The keeper appeals. Just use the template appeal from the NEWBIES thread (not the sadly awful one provided by MSE in their article).
