DCB Legal - small claims letter - discontinued

Hello, 
So we got this letter today from a fine back in 2018. We ignored all the letters but now have this. Worried about a few things, 
1. My partner packed right in front of the parking sign that clearly says get a free ticket and is in the pictures they first sent. 
2. We are trying to buy a house and a CCJ would really not be good. 

Can we call and agree to pay the origanal cost? 

I have read and still trying to understand thread 2 about sending of for information and such but I feel like we would lose our case when it goes to court plus all the stress and time to try and fight it. Just feel like we would fail and then it would affect us trying to get a mortgage. 

I know I send a request to UKPCI and an e mail to dcb about debt advice. 

I will say when they issued the PCN, UKPCI were current not on the DVLA list as they were banded for a short while. Don't know if that would help. 

Just panicking so any advice would be great. After work I will again read through the thread to try and understand better.

    You seem to be on top of it with a SAR to submit to the parking company and a pre-action protocol for debt claims letter for 30 day hold to the solicitor.  This will give you the time you need to compile a sturdy defence.  There is NO chance of a CCJ even if you go to a court hearing and lose, providing you pay whatever the judge states within the timescale set by the judge.  Remember that it is all done in the name of the keeper.

    Will start this today and hopefully get some sort of defence, just worried as she parked right in front of the damn sign 😂. 

    It's all in her name but I would rather be with her or say it was me.

    You can accompany the defendant to a hearing either as a Lay Rep or a McKenzie Friend, different and Auntie Google will explain.  Best not to lie in a court of law! unless of course there was some doubt abut who was driving on an unremarkable day several years/months ago.  The defence template is there to help you, you only need to adjust paragraphs 2 & 3.

    It is amusing that DCBL , DESPITE BEING TOLD, STILL ADD THE FAKE OF £60

    For a reason only known to them they have no legal authority to fake and scam the court and you
    All they are relying upon is a code of practice that includes the fake add-on.    Whose code of practice ?   The BPA of course who have a board member who runs a debt recovery company and invented this money scam.
    BUT the BPA is an un-regulated association who have no authority to scam the public .... but they do.

    Judges will normally not allow this fake or the interest @ 8%

    As it's the infamous UKPC, playing catch up for their losses due to the Covid, their claims are rubbish which would explain why DCBL of late DISCONTINUE claims before they get a court spanking.

    The other day we got this letter saying they will take us to court and loads of forms to fill in. I have put every page from the letter. I will be hopefully completing the defence from the newbie thread this weekend.

    With a Claim Issue Date of 11th April, you have until Tuesday 2nd May to file an Acknowledgment of Service but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 15th May 2023 to file your Defence.
    That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    You do not have to fill in those forms - just follow the advice above
