Your contribution/addition to the defence template (paragraphs 2 and 3) should indeed be a brief explanation of the events at the material time, plus a brief reason why you are not liable.
You need to read and understand the whole of the template as well, and submit the whole template plus your additions to the CCBC via email.

Post your amendments, and only your amendments on this thread for the regulars to check before you submit the whole defence.

Note that exhibits and evidence will be submitted later, and that the defence is written in the third person, so no me, myself, and I.

  • 2. It is admitted that the Defendant was the registered keeper and driver of the vehicle in question.

    3. The Defendant parked in a disabled parking bay at Metro retail park after discovering the last Parent and Child parking bay was taken by an elderly couple.  At the time the Defendants Type 1 Diabetic daughter was suffering from a severe hypoglycaemic episode (Blood glucose 2.8mmol) so the Defendant parked in the closest bay to the Toys R Us store where she proceeded to carry her daughter in order to treat the hypoglycaemic episode and allow her to access a lavatory.

The Defendants father who was a passenger in the vehicle and a Blue Badge holder threw the Blue Badge onto the dash where it unbeknown to him did not land.  As this was a medical emergency the Defendant felt justified in her actions.

Change the second bit to the passenger's Blue Badge must have slipped off the dashboard after being displayed, perhaps due to the urgency of the situation. The Blue Badge and evidence of medical conditions of the passengers will be evidenced later.

If you appealed at the time, say so.

The Defendant appealed the Parking Charge within the allocated appeals timeline which was rejected by the Claimant.

The passenger in the vehicle was a Blue Badge holder, the passenger in the urgency of the situation threw and the Blue Badge was placed onto on the dash but no one knows why it did not remain there where it unbeknown to him did not land.  As this was a medical emergency the Defendant felt justified in her actions.

Some changes to reflect what @Coupon-mad suggested.  Plus every paragraph requires a number.

Yep, I said to remove this:

"threw the Blue Badge onto the dash where it unbeknown to him did not land."

Add in the rest of the template and send by e-mail to the address in the defence template thread.
  • I've just received my SAR, the last correspondence they sent (which i definitely did not receive) requests a copy of the blue badge - which I have had all along.  Is this going to affect anything?

No. Don't mention that letter and they probably won't put it into evidence. You will of course be appending the Blue Badge and other exhibits to your WS in due course.
