Safe Hands Funeral Plan

After being diagnosed with terminal cancer, I purchased 2 Pearl funeral plans from Safe Hands for my husband & I back in November 2015.
The company has gone into administration & it looks like we will probably loose the policy & the nearly £6000 that they cost.
I have been onto my credit card company for help, as the policies was paid through them, but they only keep records for 5 years & so are unable to help as I can’t prove I paid it through them.
We are living on a budget of pensions & benefit’s & will be unable to afford to purchase another policy.
Is there anywhere else I can go to try & recoup our money?

    With respect to your credit card company, the fact that they can't easily verify your payment does not stop you claiming. If you are quite certain that you paid on your CC, that is 'evidence' that a court would consider. I suggest that you have a word with a solicitor, using their free 30 minutes interview to get a preliminary view about whether it is worth proceeding.

    Funeral plan provider Safe Hands has gone into administration – what to do now if you have a prepaid plan with Safe Hands or others (moneysavingexpert.com)

    • If you need to organise a funeral now, contact Dignity Funerals Limited. Dignity has agreed with Safe Hands' administrator, FRP Advisory, to provide funeral care arrangements for existing Safe Hands customers who need them for the next six months. You can contact it on 0800 640 9928. The administrator has confirmed that Safe Hands customers won't face any additional fees for this service.

      Dignity are working with the administrator, the regulator and others to find a long term solution. Other funeral providers are also offering their services to Safe Hands customers but this is not via the administrator and there will be additional costs involved. 

    • If you don't need to arrange a funeral urgently, you may need to make a claim as a creditor to Safe Hands' administrator FRP Advisory to try to get your money back. Safe Hands does not have the funds to provide refunds so it is exploring the possibility of transferring funeral plans to an alternative provider. If this isn't possible, you'll need to claim as a creditor - customers are being contacted by post with details of how to do so, though you'll only receive a partial refund.

      If you paid for any part of your funeral plan by credit card, you may, however, be able to reclaim costs under Section 75 of the Consumer Credit Act 1974 instead.

    This is what the OP has already been attempted by the OP, but she has been told to provide documentary evidence that the payment was made by CC. I don't think that's as much of an obstacle as the Op has been led to believe. For a start, I doubt that the CC company really has thrown away all its records from 2015, although they may be harder to retrieve. 

    A visit to a solicitor will help with that, as well as advice on, for example, the statute of limitations.

    Make a subject access request to the credit card company and ask for your full transaction history. Their claim that they only keep records going back five years is worth testing. 
    Ask the administrator for details of how you paid for your policy - Safe Hands may still have the record of payment details (including credit card issuer) at their end. I expect it will take them a considerable length of time to reply, and it isn't certain that they'd've kept the records either, but it's worth a try.
