    Could you please check your original court claim as the court fee would only have been £25 if it was issued on MCOL in 2016.

    OP-Please ignore clearly the "heat" has got to me!

    If a judge has required a claimant to submit revised particulars of claim (POC) and advised the defendant that he can submit a defence based on the new POC, it is normal to use the old defence and edit it so that the judge knows it is an edited version. You use strike through of text you don't want and add new text in bold or italic to show it is different and it is based on the new POC.
    Have you received new POC?

    You don't have to.

    Has anything changed?

    I would however be tempted to write a letter to the judge confirming receipt of the revised PoC which you note do not refer to Sch4 of PoFA as directed and confirm you do not need to amend your defence because you presume the case has now been automatically struck out in accordance with his directions.

    Afternoon All,

    just an update on the above, after sticking with my original defense I have had the below from the court and an offer of settlement from DCBL. am I right in thinking this is a good position to be in ? assume if they are offering a lower settlement figure they are not confident of a successful case ?

    Yep, sit tight (DCBLegal will probably discontinue) but read the second page of that Order, because with a hearing in ten months' time, your local court might well be stating in that Order that you are required to file & serve your WS bundle this year...

    Good to see they are ahead of the game!  Don't forget it, diarise it somewhere with an alarm!  If you move address, make sure you update the PPC, their solicitors and your local court where the hearing is scheduled.  You don't want a judgment in default by failing to turn up if they change the date.
