Hi,
im so sorry to do this & I know you will all say “check the newbies” thread but I have looked and have no idea what it all means as I’m an elderly persons however,
I have recently found a letter for my son from a debt collection agency for an unpaid parking fine - he stupidly buried his head in the sand and didn’t tell us..
I will attach the letter.

Where do I go from here? I’m literally at a loss as I have never faced this, they are threatening court. Can someone please guide me where to go.

A letter from DRP.
The fourth post of the NEWBIES thread explains exactly how to deal with debt collectors' letters, but to summarise that post - ignore them.
You could search the forum for Abigale and find many similar posts - like this one...

I’ll be honest I’m extremely uncomfortable just ignoring them with the threat of court action, however I will take your advice and check the forums. What should I / he expect next from the debt collectors after 7 days?0 -
As above.
DO NOT RING DR PLUS and certainly don't pay! Your son is not wrong to ignore this stage. It's nothing. But do open his letters (with his permission) -keep them all safe in one place, laugh at them but don't bin them - and if he gets a court claim he can't ignore that.
Google N1 claim form and look at images so you know what a real claim looks like. If he gets that later on, STILL NO PAYING but send him straight here.m because we successfully defend these every day.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hot air, they are useless scammers that make up things, eventually when they realise they are being ignored they will go back to their clients who engage them on a no win no fee basis and hand it all back out of pocket.

Don't worry about court - and I am doing exactly the same for my son. I opened his post and ignored all the debt chasing letters. I then dealt with the Court claim doing exactly as advised on here.MrsAbbot72 said:Where do I go from here? I’m literally at a loss as I have never faced this, they are threatening court. Your son will need to think about his defence, what happened? what signs did he see? how long did he park? was he the driver? Did he pay? Just have a chat with him.

How clear are the terms and conditions of parking, can you see any?
Under no circumstances should you contact the debt collectors - they will lie to you, they will not back down or agree to anything. Ignore them.
The private parking scam is run by rouge companies which have conned numerous retail parks, hospitals, residential complexes and various other places that have car parks that they need a parking management system.
They then put up some small unreadable signs, install an Automatic Number Plate Recognition (ANPR) system and start printing invoices (parking charge notices). They claim their signs contain contractual terms and conditions, but how can anyone agree to those terms if they have not seen, read or understood them?
What follows is a robo claim process, an automatic succession of computer generated template letters, designed to scare the hell out of you. Unfortunately it works and far too many simply pay up.
The overwhelming majority of those who fight back actually win, but to do so you must follow the process, step by step, and not panic.
My Son and I are now waiting for our day in Court, totally confident that his defence (already filed) is bullet proof.
Encourage your Son to have a look at this forum, follow some threads and educate himself about parking scams and how to defend himself. A useful life experience which may wise him up about the few who try to exploit the rest of us.

Fantasy Island is a Smart Parking location. Smart are highly unlikely to issue any court proceedings. This is a site which has been subject to controversy previously. See if your son's case is similar. Has he complained to the FI landowner to try to get them to tell Smart to cancel?

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi,
apologies to bump this thread.Need some advice / reassurance.
I got into contact t with Fantasy Island who have agreed to cancel the parking fine (no idea why the change of heart)
but it says on my most recent letter from Debt recovery plus
“has the right to appeal the ticket now passed - Yes”
so, does that mean that Debt recovery plus will continue to try and collect monies even though the land owner has agreed to cancel?
im confused?0 -
Nope, DRP will have to wind their necks in!
Don't worry. A landowner cancellation is an order from the parking firm's client to cancel the PCN. It's not an appeal.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Different people. Fantasy Island can cancel anytime. The Debt collectors are never interested in any thing other than, er, debt collecting.Fantasy Ireland should call the debt collectors off, if the debt is cancelled there is nothing to collect.
