If the car is in your Mum's name, i.e. she is the RK, what has happened that caused your Dad to be the defendant?

I can only assume that Mum has never even seen any of the letters as Dad has picked them up and binned them.

This is a tricky one and probably needs more-focussed help from @Coupon-mad and/or @ParkingMad

sorry for the confusion. The tickets happened when I took my Dad out shopping to Parc Prestatyn shopping park, with his mobility problems & dementia the shopping trip took a while & we went over the 3 hours free parking. I emailed Edison the owners of the shopping parc but had no response.I thought it was ok & we hadn't heard anything else (Dad binned any parking eye letters)

So your Dad binned any letters even though they were addressed to Mum?

I'd pay the Judgment - there's only £2 difference between that and the cost of a set aside application (which I think will be difficult to have granted).  Failing with a set aside application will mean the total cost of this is then £552 - very risky in my opinion.

As an aside, for regulars, looks like PE have now jumped on the Osner gravy train!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Indeed. And it's not as if they can plead ignorance re. the Beavis case. 🙄

I agree that you need to pay the Judgment.

If you did decide to apply for set aside and it was granted the driver or keeper would still have to defend the claim. Given your father's illness your family may not want this extra stress.

I would certainly write to your MP. Any claim involving a disabled badge holder should be treated as dealing with a vulnerable person with regard to debt collection.

I not sure that's true because the OP mentioned 2 PCN's in their first post which would suggest the £170 is made up of (2 x £85). The "costs" of £107 would have included the court issue fee of £35 and probably a solicitor fee of £50 which would only leave £22 unaccounted for.
