A LITTLE ADVICE- ACCOUNT CLOSED QDR SOLICITORS

I am not sure if my PCN had finally been dropped. I received a PCN ticket from parking in a One Parking Solutions car park back in November 2021 for overstaying the grace period by 4 minutes. I never received the initial letter so, they refused to give me a POPLA code as the length of time had passed. I followed all your advice, appealing to them, which was rejected. It then went to ZZZP debt collectors and I followed all your advice with regards to them. (I thank you for all the time you have invested in helping others like me) I have never given them my name, and have never admitted who was driving. It then went to QDR solicitors. I then submitted a subject access request, as well as a cease and desist letter. QDR solicitors contacted me via email asking for my permission for them to contact me by email. I said no, as the email is used by multiple people and they could only contact me via post.. Is worth noting, despite me asking for all info with regards to the SAR be sent by post, that was also emailed to me. (I was not sure what to do with it to be honest) Anyway, what i am asking is I received a letter today from QDR solicitors stating that my account is now closed and has been sent back to ZZZP. What does this mean. I can't find anything on here offering advice about that. Does this mean they will not pursue me any further? Like I said I have followed all your advice step by step. So, I am really not sure what to do now? Any advice would be appreciated. I naturally assumed the next step would be to go to court, but I have not received anything suggesting that will happen. I just do not want this hanging over my head for years, like I have read with others on here!

Well ZZPS are bedfellows with QDR so it just means QDR haven't taken it further, not that it's cancelled.

You can't get a PCN for a 4 min overstay. You mean 14 mins over.

Which OPS car park? Don't use their rubbish sites.  Let me guess: Vantage Point Brighton?

Thanks for replying. Yes, I suppose it was 14 minutes. I meant 4 minutes over the 10 minute grace period. No, it is a little car park in Elm Park, Essex. The car park was completely empty. I did not even realise it was one of their sites as I have parked there loads of times, I just assumed like other car parks in the area you got 30 minutes free. I was only over the 10 minutes this time as I got caught in a queue and I forgot my bank card. So, does these mean I am in the clear?

No wonder it was empty! NEVER seek out private car parks to park a car. Certainly read signage!

You will be sued.  You can defend but you will get a claim, at some point. No biggie.

Why use a private car park at all when you can park on street there? just trying to understand why drivers think they need a 'car park' when the streets in the area are parkable?  That's what we all do here. And read signs if you have no choice but to use a car park.

There is very little street parking in this area and most it is also pay and display because it is right by a tube station. I was only popping into the pharmacy which is only across the street. If I was planning on staying longer I would have paid. So, if I am going to be sued, why have QDR solicitors said they have closed my case? Maybe I am being dim, but I would think if they were going to bother to take me to court, they would have done it by now. I even wrote to my local MP complaining about the bullying tactics they use. I mean the latest amount they were demanding was £182.00. In my appeal I even said I would be happy to pay the £2.50 which is what the parking fee would have been for parking there. But nope, did not accept that. So, do I just have to sit and wait until I get another letter? Have you seen this happen before? Thanks again in advance.

QDR are debt collectors basically, who have tried and failed to collect an alleged debt (you don't have a debt unless it goes to court and a judge says you do).

As they have thrown in the towel they have decided not to waste any more time and effort so have handed it back to ZZPS to try again, they will also give up eventually and hand back to the PPC.

Thanks both. So, I assume if it goes to someone else I will just have to do the same things all over again? i.e another SAR and a cease and desist letter. Is there any other way of resolving this apart from paying the outrageous amount of money they are demanding, which I refuse to do.

Landowner complaint is the only other avenue. The principal can usually cancel at any point but whether they will is hit and miss.

You will get letters galore as they pass your data around, and you must tell them if you move house within the 6 years the courts allow for small claims.

It will go quiet apart from the aggressive demands for £170 that you won't be paying, but Don't disappear just yet. We need you!  Join us in trying to end the conniving PPC and DRA 'added fees' fuelling the aggressive culture of 'pass you around then if the gaslighting doesn't work, it's court'. 

What a waste of your time this is, and why should there be such a demand/enhanced money/litigation regime in private parking?   It's truly horrible being pursued for £100 for no reason, by an ex-clamper aggressive firm, isn't it?

We know how horrific and draining this is, even for robust people who see right through the scam.

There will be one window of opportunity later this Summer.

Together, we can stop the rotten parking industry from riding roughshod over the new statutory Code and the charge level caps, and otherwise bullying all motorists forever, using the regulation to gain kudos and status.

The PPC moneymakers have blocked the new Code with Judicial Reviews.  Stopped the declared and much welcomed parking code from February 2022, which stated that added £70 false 'DRA fee' extortion was to be banned and that parking levels would start at £50.

This Summer will be your chance to make a difference, plus any other drivers you know (family, friends) who are also fed up to the back teeth with the greedy and unscrupulous parking industry and the stranglehold they have on people.

We need high numbers of real victims to make a point of responding to this final Consultation.

The SAR goes to the PPC, nobody else, so you only need to send it once if you haven't already done so, unless you believe the PPC holds personal data that has not yet been given.
