N180 question

Hi everyone. I was following the newbies thread and filling out the N180 DQ. The newbies thread seems to have the questions different so maybe the form has been updated.

Question D1 - Suitability for determination without a hearing - Do you consider that this claim is suitable for determination without a hearing, I.e by a judge reading and considering the case papers, witness statements and other documents filed by the party, making a decision, and giving a note of reasons for that decision? If no, please state why not?

Unsure of how to go about this. Any advice?

I have filled in all the other questions and plan on sending it via email asap as I have already had the warning even though I never received the letter advising me to fill out the DQ.

  • Hello,
I did not want to create a new thread. It is about N180. I've tried to google the info, but the information is really mixed up.
Could someone please clear my mind?
I've received an email from Gladstones 2 weeks ago:
''We act for the Claimant and have notified the Court of the Claimant’s intention to proceed with the Claim.  Please find enclosed a copy of the Claimant’s completed Directions Questionnaire, which has also been filed with the Court. You will note the Claimant has elected to mediate in an attempt to settle this matter amicably, without the need for further Court intervention. Should you agree to mediation, please inform the Court who will contact both parties to arrange a mediation appointment.''I filed my defence in MCOL 2 weeks ago. I don't think I need a mediation as I deny any debt - not paying a penny to scammers. Or shall I play along just to look better in the eyes of judge and accept the mediation?
Do I need to wait for the N180 form to arrive from court? I'm scared to get a default judgement if I miss something. I really want to kick Gladstones !!!!!! in court.

All of this is covered in the 12 steps in the first post of the Template Defence thread.

And how to fill in the N180 (and why NOT to agree to mediation) is in the NEWBIES thread 2nd post under the red capitals heading called IMPORTANT: KNOW WHAT HAPPENS WHEN
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

I really hope you didn't but instead followed the instructions in the Template Defence to use CCBCAQ@Justice.gov.uk  to send your defence by e-mail.
