DCB legal - Letter of claim

Everything from this point on needs to be done in the name of the named Defendant.
The defendant is my husband.0 -
Ok, so am I to file my defence as an email and not send it via the MoneyClaimOnline website?KeithP said:
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
I will read through the forum and understand I need to file an Acknowledgment of Service ASAP. Is that correct?0 -
You need to delete that image. It shows your MCOL password clearly.helpadviseneeded said:Under particulars of claim it states he agreed to pay in 28 days but did not.
Is this a standard comment as at no point did he say he would pay as he had a valid permit? The allegation is that by parking the driver agreed to the terms of the contract. Those contract terms are the terms on the signs.Almost certainly there is a term on the signs stating something like "if the driver doesn't park in accordance with the rules then he agrees to pay £nn within 28 days...".2 -
I have deleted the image.
Am I correct that the AOS is done online on the MoneyClaimOnline website?

My earlier post, which you have quoted, answers your first question.
That same post also answers your second question.2 -
I am in the process of drafting the defence. Should I be adding in all the information about all the laws and adding them in? Does anyone mind me sending the draft to them to look over as I really do not know what to include and this is overwhelming.0 -
If you are using the template, just give us the parts you have altered .... usually paras 2 and 3. We do not need the rest, and it just takes up spaceThe pen is mightier than the sword ..... and I have many pens.1

Do remember as seen on EVERY DCBL thread ..... YOU ARE BEING SCAMMED BY DCBLhelpadviseneeded said:
A claim form has arrived today stating :
amount claimed £240.76
court fee £35
solicitor fee £50
Total: £325.76
The "amount claimed £240.76" is a fake .... most judges are aware of the DCBL fakery and do not allow
This is one parking ticket @£100. If you lost the total would be £185. Why would you lose ? When you win you can claim your costs, normally £95
It is very important that you read this thread BY UmkomaasDCB LEGAL RECORD OF PRIVATE PARKING COURT CLAIM DISCONTINUATIONS
https://forums.moneysavingexpert.com/discussion/6377263/dcb-legal-record-of-private-parking-court-claim-discontinuations/p1
Whatever rubbish DCBLsay about the fake add-ons, in 2016 the code of practice made no mention of the fake-add-on ...... It was only in the latest code of practice that the BPA decided to scam the public
That simply means that this is before in 2016 and there will be no signs that UKPC can display the fake add-ons.
For UKPC to prove this claim they need to show pictures of the signs in 2016 ..... not stock pictures or doctored pictures which UKPC are famous for
Of late DCBL are claiming "damages" as a work around to the fake
UKPC will only be agents for the landowner. As an simple agent, UKPC are not entitled to damages ....... damages apply to the landowner and as the DCBL does not involve a third party like the landowner, rest assured you are being scammed
The funny thing is that by way of this forum, DCBL have been told that they are being scammed by UKPC, just as UKPC scammed CSTLAW
All this claim rubbish is to make you pay but as we see and you can see in the thread above, DCBL realise they are not dealing with a mug and discontinue .... otherwise another court spanking awaits them
You have more to offer in defence than they have

Such a shame.
This one could have been timed out and and exact advice was given how to avoid the claim. Now the Defendant has to go through the stress of defending this court claim and the 6 years is irrelevant. Oh well, easy enough.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

HI coupon-mad
I know, I am so annoyed with myself for not keeping on top of this.
I am in the process of getting the defence together, I genuinely thought as my husband has the valid permit that if it went to court we could easily fight it as we emailed it over every time we were in contact with them.
UKPC only replied once to say they emailed asking for it and we ignored the request. This is wholly untrue (it may have got spammed as it was a works email address) as these alleged emails were never received.
The permit was scanned and it was attached to all correspondence including the appeal.
In my defence should I be listed everything that has taken place and note this as a separate number
e.g.:
1. The defendant appealed on ...
2. There was no response, the defendant contacted xyz, etc
Should it be like a timeline?
